This article is adopted pursuant to the provisions of § 10 of the Municipal Home Rule Law of the State of New York, § 23 of the Town Law of the State of New York, and § 3 of the Public Officers Law of the State of New York.
The person or persons appointed to the position of Code Enforcement Officer in the Town of Clayton shall not be required to be an elector or resident of the Town of Clayton in order to hold and serve such position, but said person or persons must be a resident of the County of Jefferson.
This article is intended to supersede any inconsistent authority, including Town Law §§ 20 and 23 or Public Officers Law § 3, to the extent such statutes establish eligibility for the Code Enforcement Officer within the Town of Clayton contingent upon residency within the jurisdictional limits of the Town of Clayton.
