[HISTORY: Adopted by the Town Board of the Town of Urbana 4-2-1996 by L.L. No. 1-1996. Amendments noted where applicable.]
This chapter shall be known as the "Beach and Vessel Regulations Law."
As used herein, the following terms shall have the meanings indicated:
BEACH
The land area owned by the Town of Urbana, located in the Village of Hammondsport under and adjacent to Keuka Lake, commencing from the shoreline and extending toward and into the lake therefrom for a distance of 1,500 feet.
SWIMMING AREA
All area designated for such purposes by the Town of Urbana and specifically excluding the east end of William Street, which is designated by signs as a boat launch and a dock area.
The beach swimming area shall be that portion of property adjacent to Keuka Lake, commonly known as the "Head of the Lake," which is designated by the Town of Urbana as the beach swimming area.
A. 
Swimming is allowed in such area only during posted hours and only when a lifeguard is on duty.
B. 
No flotation devices, glassware or boats shall be allowed in the designated swimming area.
C. 
No animals, other than Seeing Eye dogs, shall be allowed in the designated swimming area.
D. 
No alcoholic beverages shall be possessed or consumed in the swimming area nor on the adjacent beach area.
The boat launch area and boat dock area shall be that portion of its Keuka Lakefront property designated by the Town of Urbana as a boat launch area and a boat dock area.
A. 
No swimming, sunbathing, waterskiing or loitering shall be allowed in either the boat launch or the boat dock areas.
B. 
No person shall moor a water vessel in the boat dock area in Depot Park between the hours of 2:00 a.m. and 4:00 a.m.

C. 
No animals, other than Seeing Eye dogs, shall be allowed in either the boat launch area or the boat dock area.
D. 
Use of the boat launch shall be restricted to Town of Urbana residents or real property owners who have obtained a permit from the Town Clerk's office. The required fee for the permit shall be established, from time to time, by resolution of the Town Board of the Town of Urbana.
Any person, upon conviction for violation of any of the provisions of this chapter, shall be punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both such fine and imprisonment.

A. 
Purpose. The purpose of this section is to establish a procedure for the orderly use by commercial vessels of the Town's docks and boat launch area in Depot Park and Champlin Beach.
B. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
COMMERCIAL VESSEL
Any type of marine vessel which is used to provide any type of services to the general public for consideration of any kind.
PERSON
Any individual, partnership, corporation, limited liability company, joint venture or any other entity of any kind who or which provides commercial marine services to the general public.
C. 
Prohibited use/limitations on use.
(1) 
Unless otherwise permitted by the Town Board, no person shall moor a commercial vessel to any Town dock in Depot Park and Champlin Beach without first obtaining a permit from the Town.
(2) 
The permit will allow a person to moor a commercial vessel to the Town's docks/slips solely for the purpose of boarding or discharging passengers or crew members, each said mooring not to exceed 15 minutes, and there shall be no solicitation of any kind conducted at any of the Town's docks/slips.
D. 
Permit. The applicant must submit a written application to the Town Clerk, which application shall contain information, including, but not limited to:
(1) 
The full name of the person;
(2) 
The person's principal mailing address;
(3) 
If the person is an entity other than an individual, the name and the mailing address of a contact person for said entity;
(4) 
Copies of all current permits, licenses and/or certification issued by any governmental agency permitting the person to operate a commercial marine vessel providing a service to the general public.
(5) 
The person must submit to the Town Clerk a certificate of insurance evidencing the existence of current general liability insurance coverage with the limits of liability of not less than $1,000,000 per occurrence and $2,000,000 aggregate and naming the Town of Urbana, New York, its officers and employees as additional insureds.
(6) 
The make, model and year, and New York State registration number of each commercial vessel.
(7) 
Payment of the permit fee as established by the Town Board.
(8) 
Upon issuance, the permit shall be valid for a period of one year from the date of issuance.
E. 
Nonissuance/revocation.
(1) 
Any person found to have violated this section shall not be eligible for a permit for two years immediately following the year of violation.
(2) 
The Town Board may revoke the permit upon a violation of this section upon notice to the permit holder and a right to be heard.
F. 
Assignment. The permit holder shall not assign the permit.
G. 
Enforcement. The Town Board authorizes the Town Zoning Officer, his agents and any other person authorized by the Town Board to administer and enforce this section.
H. 
Penalties for offenses. Notwithstanding § 37-5 of the Code, a violation of this section shall not constitute a crime, but rather a violation. Any person, upon conviction of a violation of this section, shall be fined an amount not to exceed $250 for the first offense and an amount not to exceed $500 for the second or any subsequent offense. Additionally, such person shall be subject to imprisonment for a term not to exceed 15 days for each offense or both such fine and imprisonment. The court may issue a warrant for a person's arrest in the same manner as in a misdemeanor case. The continuation of any offense against the provisions of this section shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
