The following schedule of fees is hereby established with respect to licenses, permits and activities required or regulated by the Board of Health:
A. 
Food establishments shall be licensed according to N.J.A.C. 8:24, Risk Type 1, 2, 3, or 4. Fees are based upon risk type.
(1) 
Risk Type 1: $100.
(2) 
Risk Type 2: $175.
(3) 
Risk Type 3: $250.
(4) 
Risk Type 4: $350.
B. 
Temporary retail food establishments not to exceed seven consecutive temporary days of operation in a single event.
(1) 
Risk Type 1: $25.
(2) 
Risk Type 2: $100.
(3) 
Risk Type 3: $125.
(4) 
Risk Type 4: $175.
C. 
Produce stands.
(1) 
Produce stand or market offering only uncut fresh fruits and vegetables: $100.
(2) 
A temporary produce stand or market not exceeding seven consecutive days of operation and offering only uncut fresh fruit and vegetables in a single event: $50.
(3) 
Farmers' market vendor: $100.

D. 
Nonprofit organizations must request, in writing, to the Board of Health a waiver for fee exemption approved by the Board of Health. No fee shall be charged for a license issued to a church, school or nonprofit organization, society or group approved by the Board of Health; provided, however, that this fee exemption shall not apply to a commercial caterer serving food at a function of any such organization.
E. 
Food facility plan review.
(1) 
New construction, conversion of an existing structure or remodeling or change of a food facility requires that properly prepared floor plans, equipment specifications, proposed menu, volume of food to be stored, prepared and/or sold and/or served be submitted to the Health Department prior to any construction, remodeling, alteration or changes of the facility.
(2) 
Required submission shall include:
(a) 
Layout of equipment and facilities in a floor plan drafted to scale.
(b) 
Mechanical schematics, construction material and finish.
(c) 
Equipment types, manufacturer's specs (cut sheets), model number, location of equipment on floor plan with a legend for each piece of equipment coded with a sequential number listed on the plan, in the legend and on the manufacturer's spec (cut) sheet.
(d) 
Performance capacities and installation instructions for each of the equipment.
(e) 
Other information as may be required by the Health Department.
(3) 
Period of review.
(a) 
Upon submission of the plans and specifications as identified above, a date stamp shall mark the receipt of submission.
(b) 
The Health Department has 30 days from the plan submission date to approve the plan. If there is missing or incomplete information, the thirty-day period will only apply when the additional information is submitted as required.
(c) 
Construction, renovation, remodeling or changes shall not begin until the Health Officer has given his formal approval of the plans as is or as modifications may be required.
(d) 
Construction, remodeling, etc., of the facility shall be consistent with the approved plans. Any changes must have written prior approval of the Health Officer.
(e) 
Fee schedule for plan review: $50.
F. 
A preoperational inspection is required and the facility must pass with a satisfactory rating before a new constructed, renovated, or converted establishment can be granted a license to operate. A satisfactory rating is only issued when the Health Department determines compliance with N.J.A.C. 8:24-1 et seq.
G. 
Miscellaneous.

I. 
Wells.
(1) 
Well search: $5 per street.
(2) 
Well record: $15 per well.
J. 
A late payment fee is hereby established as follows: 25% of the established annual licensing fee.
K. 
For those new establishments commencing business from October 1 through December 31 of the year, the licensing fee shall be 25% of the established annual licensing fee for that calendar year.
L. 
A five-day period of grace following the established license deadline is hereby established.
M. 
All ordinances and part of ordinances inconsistent herewith are hereby repealed.
N. 
This chapter shall take effect after publication in the manner provided by law.
Any individual, company or business establishment causing or affected by a situation requiring an inspection or emergent service by the Department of Health personnel during off-duty hours shall be billed by the Department of Health for the reasonable cost of said inspection or emergent service response.

A. 
The following schedule of fees and penalties shall be applied to any business where an inspection is conducted by the Department of Health, whether periodically or sporadically, fails to receive a satisfactory rating for that inspection, and subsequential reinspection is as follows:
(1) 
First reinspection: $75.
(2) 
Second reinspection: $150.
(3) 
Third reinspection, and any subsequent reinspection that follow: $200.
B. 
In addition to the indicated fees, the following actions are to be taken by the given business entity and its representatives.
(1) 
Upon failure to meet standards that would result in gaining a satisfactory rating by the end of a second reinspection, the business owner and their representatives would have to appear before the Board of Health to discuss the matter; and
(2) 
Upon failure to meet standards that would result in gaining a satisfactory rating by the end of a third reinspection, the business would be closed automatically and remain as such until a satisfactory rating was obtained through inspection.
C. 
Severability.
(1) 
Nothing in this section, subsection, paragraph, sentence, clause, or phrase shall prevent the closure of a facility, a cease and desist of services, or any other penalty that may be prescribed by the violation of any provisions as outlined in any section in the New Jersey Administrative Code or as outlined in any other section of Borough legislation.
(2) 
If any section, subsection, paragraph, sentence, clause, or phrase of this section shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this section, which shall continue in full force and effect, and to this end, the provisions of this section are hereby declared to be severable.
D. 
This section shall take effect 30 days after the first publication thereof after final passage as provided by law.
