No person in any public park or recreation area in the Borough of Monmouth Beach shall:
a. 
Willfully mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, tables, benches, fireplaces, railing, pavings or paving materials, water lines or other public utilities or parts or appurtenances thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes, posts or other boundary markers, or other structures or equipment, facilities or appurtenances whatsoever, either real or personal.
b. 
Dig or remove any soil, rock, sand, stones, trees, shrubs or plants or other wood or materials, or make any excavation by tool, equipment, blasting or other means of agency.
c. 
Construct or erect any building or structure of whatever kind, whether permanent or temporary, or run or string any public service utility, into, upon or across such lands, except on special written permit issued hereunder.
d. 
Damage, cut, carve, transplant or remove any tree or plant or injure the bark, or pick flowers or seed of any tree or plant, dig in or otherwise disturb grass areas, or in any other way injure the natural beauty or usefulness of any area.
e. 
Climb any tree, or walk, stand or sit upon monuments, vases, planters, fountains, railings, fences or upon any other property not designated or customarily used for such purposes.
f. 
Tie or hitch an animal to any tree or plant.
g. 
Drive any vehicle except bicycles on any area except the park roads or parking areas. Such prohibition shall not apply to Borough maintenance equipment or fire or emergency equipment.
h. 
Fail to vacate a field or court at the conclusion of any permitted use or at the direction of any Borough representative.

i. 
Use any field or court for private enterprise including coaching, lessons, etc., unless conducted by a permitted organized entity.

Permits for special events in parks, open space areas, sanctuary and recreational areas shall be obtained by application to the Recreation Commission in accordance with the following procedures:
a. 
Application by individual. Any person may apply for a permit to reserve a specific athletic field and/or court. Said application shall be filed electronically at least 30 days prior to the requested date and time with the Borough of Monmouth Beach, through the appropriate link on the Borough website. Proof of the issuance of the permit shall be provided, upon request to any representative of the Borough, the Borough Recreation Commission and/or law enforcement.
b. 
Limitations of permits.
1. 
The ability to reserve a specific athletic field and/or court may be limited in the discretion of the Borough so as to allow for the orderly scheduling of the use of said fields and courts and facilities and permit general unreserved access to such facilities in the discretion of the Borough.
2. 
Reservation of tennis courts shall require a valid registration card pursuant to § 10-3.
c. 
Use and vacation of field/court. When a permit is issued, the person holding such permit shall have the exclusive use of the field or court area for the specific date and time designated only and must vacate the field if any person has either reserved the field/court (if such reservation was permitted) or if any person desires to use the field/court if the time following a reservation was not capable of being reserved.
d. 
Group and entity permits/reservations.
1. 
Permits shall be obtained by electronic application for any nonprofit organized groups and entities for use of the athletic fields and courts or recreational facilities. Said application shall be submitted electronically through the appropriate link on the Borough website. This requirement includes all Borough-sponsored/recognized organizations providing recreational opportunities to Borough residents. Borough-sponsored/recognized organizations providing recreational opportunities to Borough residents shall be exempt from any fee but not insurance requirements. Said organizations shall be designated by resolution of the Mayor and Commissioners.
2. 
Applications and requests for fields and courts and recreational facilities shall be accepted only after February 1 or the first business day thereafter from organizations and groups and/or individuals seeking use commencing March 1 to June 30. Any request and application shall be solely considered by Borough of Monmouth Beach Recreation Commission.
3. 
Requests for fields and courts and recreational facilities for use commencing July 1 and ending August 31 shall be accepted commencing June 1 or the first business day thereafter and shall be considered Borough of Monmouth Beach Recreation Commission.
4. 
Requests for use starting September 1 and ending December 1 shall only be accepted commencing August 1 or the first business day thereafter and shall be considered Borough of Monmouth Beach Recreation Commission.
5. 
All organized groups using any of the Parks' facilities shall assume full responsibility for any and all injuries and damages that may occur during any event and use. The group and organization using the facilities by permit agree that it and they shall defend and indemnify the Borough of Monmouth Beach and its agents, servants and employees from and with respect to any and all claims for personal injury and property damage and other claims involving said facilities and/or use that may be made against the Borough and its representatives and agents, servants and employees. With each application, the organization and/or organized group and entity shall submit an original certificate of liability insurance that shall include comprehensive general liability insurance coverage in the minimal amount of $1,000,000/$2,000,000 and workers compensation coverage and other appropriate insurable interests. The certificate shall name the Borough of Monmouth Beach, as an additional named insured. Failure to provide a proper certificate of insurance with the application and prior to use shall void any field and court use and no permit shall be issued without said certificate being provided to the Recreation Director for review and in discretion, the Director's approval or rejection.
e. 
Appeal of denial of permit.
1. 
Appeal. Within five days after the receipt of an application, the Recreation Commission shall apprise an applicant in writing of its reasons for refusing a permit, and any aggrieved person shall have the right to appeal to the Board of Commissioners by serving written notice thereof on the Borough Clerk within five days of refusal.
2. 
A copy of the notice shall also be served on the Recreation Commission within the same time and the Commission shall immediately forward the application and the reasons for its refusal to the Board of Commissioners which shall consider the application under the standards set forth under Subsection b hereof and sustain or overrule the Recreation Commission's decision within 10 days from the receipt of the appeal by the Borough Clerk. The decision of the Board of Commissioners shall be final.
f. 
Liability of persons. The person or persons to whom the permit is issued shall be liable for all loss, damage or injury sustained by any person whatsoever by reason of the negligence of the person or persons to whom such permit shall have been issued. The Recreation Commission shall have the right to require any permittee to submit evidence of liability insurance covering injuries to members of the general public arising out of such permitted activities in such amounts as may be determined by the Board of Commissioners to the commencement of any activity or issuance of any permit.
g. 
Revocation. The Recreation Commission shall have the authority to revoke a permit upon a finding of violation of any rule or ordinance, or upon good cause shown.

a. 
Registration card required. The use of tennis courts or pickleball owned or operated under the supervision of the Borough or its Recreation Commission for any purpose other than tennis is prohibited. During the period April 1 through the third weekend of December in each year, persons shall be permitted to use the tennis courts after obtaining a registration card. A reservation card may be obtained electronically through the Borough website. A registration card is valid only during the year in which it is obtained. Players must have their registration cards available at all times when using the courts and must present them upon request made by any police officer or other duly authorized Borough official. Registration cards are not transferable.
b. 
Hours of play. When weather conditions permit the tennis courts and pickleball courts shall be open for play between the hours of 7:00 a.m. and 9:00 p.m. daily.
c. 
Reservation required. During the period April 1 through the third weekend in December no person shall use the tennis courts or pickleball without securing a reservation for the period of such use. Reservations shall be made through the appropriate link on the Borough website. One person may apply providing that he or she submits the names and registration numbers of all persons who are to use the tennis court or pickleball court with him or her during the period for which it is being reserved. A second period may not be reserved for the same person or persons on the same day until after the first period reserved for play has been completed. No person shall play more than one consecutive period. Periods reserved for doubles may be for one or two hours duration. Persons who have secured reservations should advise the Borough official in charge if for any reason they cannot play during the period reserved. In the event of any error or conflict in the scheduling of reservations the matter shall be finally determined by the Borough official in charge of reservations.
d. 
Persons may use the tennis courts or pickleball courts on an available basis provided that they are registered and the court is not reserved; provided further, however, that they shall record the time played upon a blackboard provided for that purpose. Unless no other persons desire to play, no person may use the courts for more than one consecutive period of play, two hours in the case of doubles, one hour in the case of singles.
e. 
Vacant courts. Registrants may use vacant courts without reservation; provided, however, that if a person appears with a slip evidencing reservation of that court, the registrant not having a reservation must vacate the court.

All persons using the courts shall comply with the following:

Persons using or upon the courts shall wear tennis shoes or other smooth rubber soled heelless shoes. Barefoot playing is prohibited.
3. 
No persons other than players shall use or be upon the courts at any time.
4. 
No person shall use the courts as a pathway or thoroughfare.
5. 
Players shall conduct themselves so as not to disturb players on adjoining courts.
6. 
No person shall use the courts for any purpose other than to play tennis. No bicycles, skateboards, roller skates or other such devices are permitted.
7.

8. 
No person shall use loud, offensive or profane language while on the tennis courts.
9. 
Persons using the courts must be properly clothed at all times. Proper clothing requires the wearing of shirts.
10. 
No person shall litter or dispose of trash or refuse upon or in the vicinity of the courts except in receptacles provided by the Borough for that purpose.

All parks and recreational areas located in the Borough of Monmouth Beach shall be opened for use by the public one hour before sunrise and shall be closed one hour after sunset.

It shall be unlawful, and a violation of this section, to allow dogs, cats or any other domestic animal in the public parks and recreational areas in the Borough of Monmouth Beach.

a. 
The Borough Police Department shall, in connection with their duties imposed by law, diligently enforce the provisions of this chapter.
b. 
The Police Department shall have the authority to eject from the park area any person or persons acting in violation of this chapter.
c. 
The Police Department shall have the authority to seize and confiscate any property, thing or device in the park, or used, in violation of this section.

Any person violating any of the provisions of this chapter or any rule or regulation promulgated pursuant hereto shall upon conviction be subject to the replacement, repair or restoration of any damaged park property, be subject to the forfeiture of their rights to reserve or use the park amenities and shall be subject to a fine and/or penalty as proscribed by § 1-5.

a. 
1. 
Fees for the use of recreational facilities and/or participation in recreational programs shall be established by resolution of the Board of Commissioners. Such resolution shall remain in full force and effect until modified by subsequent resolution. The Recreation Commission is hereby authorized and directed to make recommendations to the Board of Commissioners regarding the imposition of such fees to defray a portion of the cost of the operation of various recreation programs within the Borough.

2. 
All fee payments and/or deposits shall be payable to the Borough of Monmouth Beach through the Borough website and paid simultaneously with the permit application. All correspondence shall be directed to that office also.

3. 
If required by the Recreation Commission, a deposit shall be paid to the Borough of Monmouth Beach in the amount of $500 in the discretion of the Recreation Commission to ensure that the buildings and grounds will be properly utilized and also left in a clean, safe and sanitary condition. A representative from the Borough shall examine the grounds and facilities following use by such group or organization and in the event all rules have been complied with and the fields and facilities are left in proper condition, the deposit may be returned to the applicant and permittee within 60 days. If the rules and/or other conditions have not been complied with, the deposit shall be forfeited. In addition, the Borough reserves the right to seek such other remedies and relief as may be appropriate in accordance with applicable law.

b. 
The Borough Recreation Commission shall be notified a minimum of 48 hours in advance of any cancellation or change with respect to any approved application and issued permit (except weather-related cancellations). Failure to notify the Borough electronically in accordance with said forty-eight-hour notice shall result in forfeiture of any fees paid and/or suspension of any future use or such other remedy or action as the Borough may deem appropriate.
