This Board of Health Code shall be referred to as the "Revised General Ordinances of the Board of Health of the Borough of Monmouth Beach, 2010" or the "Health Code of Monmouth Beach."

The provisions of Chapter I of the Revised General Ordinances of the Borough of Monmouth Beach, 2010 in the County of Monmouth concerning short title, construction and severability shall apply to all chapters adopted by the Board of Health.

In addition to the definitions provided in Chapter I of the Revised General Ordinances of the Borough of Monmouth Beach, the following specific definitions and terms shall be construed as follows:
BOARD
The Board of Health of the Borough of Monmouth Beach.
BOROUGH
Shall be held to mean the Borough of Monmouth Beach.
CODE or HEALTH CODE
Shall be held to mean the provisions of this Health Code and all ordinances supplementary thereto or amendatory thereof.
FOOD
Includes every article used for food or drink and every ingredient in such article and all confectionery condiments.
FOOD ESTABLISHMENT
Any and all stores, premises, places or vehicles used for the selling, distribution, serving, delivery, production, preparation, manufacturing, packing, storage, transportation or handling of food or drink.
PERMIT or LICENSE
The written permission of the Board.
PERSON
And include both singular and plural, as the case demands, and shall include any individuals, corporation, companies, societies, firms, partnerships, associations and joint stock companies. Wherever the word "person" is used in the Code, it shall also be held to apply to all municipalities and all municipal corporations.
All words and phrases defined herein shall also include their natural and usual meanings as well as those herein especially given.

Unless a specific penalty is provided elsewhere in this chapter, in State law or in other ordinances of the Board of Health for a particular violation, any person who shall violate any provision of this chapter or any Code or other regulation adopted by reference therein or any order promulgated under such provision, Code or regulation, by doing any act prohibited or declared to be unlawful or a violation thereby, or who shall engage in or exercise any business or occupation or do anything for which a license or permit is required thereby without having a valid license or permit therefor as required or who shall fail to do any act required by any such provisions or when such provision declares such failure to be unlawful or a violation shall, upon conviction thereof, be punishable by a fine of not less than $5 nor more than $500 for each violation.

The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.

All fees and penalties collected under any provision of any chapter adopted by the Board of Health shall be paid to the Chief Financial Officer of the Borough of Monmouth Beach.

a. 
Adoption of ordinances, rules and regulations. The Board may adopt ordinances and rules and regulations as shall, in its judgment, aid in the proper understanding and general enforcement of the "Health Code," all other ordinances and amendments thereof and supplements thereto.
b. 
The Board shall appoint a qualified person to be known as the Health Officer of the Borough who shall be the executive officer of the Board for the purpose of the enforcement of this Health Code and such other agents or officers as the Board shall deem necessary.

The Registrar of Vital Statistics of the Borough shall keep a record of all marriages, births and deaths, and grant permits for burial or disinterment of bodies and shall report to the Board every three months.

The Registrar of Vital Statistics of the Borough shall charge the sum of $10 for the provision of each certified copy of any individual record kept consistent with BH:1-4 above.
