The following rules and regulations are hereby established for the protection of Airport Park, its facilities and grounds and the people who use the Park.
As used in this article, the following terms shall have the meanings indicated:
BOARD
The Matamoras Recreation Advisory Board.
FACILITIES
Particular areas of use within the Park.
MUNCIPALITY
The Borough of Matamoras.
PARK
Airport Park, as delineated on the official survey thereof by Victor E. Orben dated __________, 2002, Drawing No. __________.
PERSON
Any person, firm, partnership, association, corporation or organization of any kind.
The Park shall be open daily from dawn to dusk, or such other hours as may be designated and posted by the Board from time to time (exception is Fire Fly Field). No person, other than Board-authorized personnel, shall be in the Park at any time other than when the Park is open to the public without the express consent of the Board. The Park shall be closed during the winter months.
A. 
No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, turf, buildings, structures or fixtures therein or any other property of the Borough located within the Park without Board permission.
B. 
No person shall remove any bench, seat, table or any other property owned by the Borough from the Park, or change the location thereof, without permission from the Board.
C. 
No person shall, within the Park, throw stones or other missiles; annoy persons; use profane, indecent, abusive or insulting language; interfere with, encumber, obstruct or make dangerous any path, drive, walk or public place; climb or stand on any fence, shelter, seat or erection; introduce, carry, discharge or fire any firearms, firecrackers, torpedoes or other fireworks, except under authority of a properly issued permit.
D. 
No person or organization shall hold any meeting or gathering composed of 15 or more persons within the limits of the Park without first having made application to the Board and having received a permit from the Board. The application shall be in the name of a person who shall be responsible for seeing that all refuse left by the group shall be placed in proper containers or removed from the grounds before leaving the Park. The Board reserves the right to deny any request.
E. 
For all gatherings for which police security is deemed necessary by the Board, such security must be paid by the sponsor of the gathering.
F. 
Motor vehicles of any kind are not allowed on Park grounds, except where designated, without special permission from the Board. Vehicles used in the course of Park maintenance or other necessary activities, including emergencies of the Police, Fire Department, or ambulance service when responding for emergency work, shall be permitted. Licensed vehicles are permitted in the river access area for launching boats or picnicking. Under no circumstance is there to be "four wheeling" ("mud bogging") except by permit.
G. 
Sound equipment (amplification) shall be permitted in the Park only by special permission from the Board.
H. 
No person shall set up any booth, table, stand or structure whatsoever, nor shall any person sell or offer for sale any object or merchandise or any other thing in the Park except by permission of the Board, and then only at the place designated or arranged by the Board.
I. 
No person shall dispose of any waste or garbage in the Park, or in the waters in or around the Park, except in receptacles designated for the respective purposes. All persons using the Park shall dispose of all waste and garbage left by them in such proper receptacles.
J. 
No person shall injure, deface or destroy any notice, rule or regulation posted at any place within the Park by authority of the Board, nor shall any person post, at any place within the Park, any notice or placard other than by authority of the Board.
K. 
No person shall set or maintain any fire in the Park, except in such a place as authorized by the Board, and it shall be properly cared for until extinguished.
L. 
No person shall allow or cause to allow any animal, whether or not leashed or attended, within or on any part of the Park. Exception: Borough streets and the Dog Park. (See § 82-4.1C, Dog park, below.)
M. 
Motor vehicles using designated roads shall observe regulations as posted. No motor vehicles are allowed off roadways or parking areas. Exceptions:
(1) 
To discharge handicapped persons (must return to allowed parking areas), unless otherwise permitted.
(2) 
To deliver food, supplies and materials.
(3) 
To perform maintenance work.
N. 
Skateboards and roller skates, cannot be used in the Park. Exceptions:
(1) 
Roller skates can be used in the skate arena during posted times, but rules posted on the arena wall must be followed.
O. 
Bicycles. Bicycles are not permitted off the roadway, except by permit. They must be parked in the bicycle racks.
P. 
Smoking. Airport Park is a smoke-free area. Smoking is only permitted on roadways and in parking areas.
Q. 
Alcohol. Alcohol is not permitted in the Park except by permit of Board-approved party permit holders.
R. 
Vandalism. Vandalism will not be tolerated and will be punished by law.
A. 
Ball fields.
(1) 
Any organizational use of the fields, A, B, C, D or football field, must be obtained by permit issued by the Board. (There may be a fee charged.) Once a permit is issued, the requested facility is to be used at the discretion of the permit holder for the time stated on the permit. The Board will be the sole decider of any conflicts.
(2) 
The fields are open to use by any nonorganized group when a permit has not been issued for that time period. For the purpose of these rules, a "nonorganized group" shall be defined as a group that meets at irregular periods of time, not on a specific periodical basis.
(3) 
Night games, softball or football must end or be suspended by 10:30 p.m.
(4) 
Ball park lights. Lights and scoreboards are to be used by permit only. There is a fee for using lights (see fee schedule).
(5) 
Physical condition of fields. When weather conditions have made the fields, in the opinion of any Board member, unplayable, the field(s) will not be used. Any field user must put the field back in the same condition they received it when play is completed.
B. 
Pavilions.
(1) 
Any use of the pavilions, or outside picnic areas, by more than 15 people requires a permit issued by the Board. The user is expected to place all garbage in the proper receptacles and leave the grounds reasonably clean.
(2) 
If tables are moved, they are to be returned to original positions. A fee will be charged per fee schedule. A deposit will be required. The user will make two separate checks to Matamoras Recreation and include a stamped, self-addressed envelope so the deposit can be returned if there is no damage to the facility. Organizations may need liability insurance.
(3) 
Pavilion rentals must end no later than 10:30 p.m.
C. 
Dog park.
(1) 
Dogs are to be immediately leashed and removed if the dog becomes threatening or aggressive.
(2) 
There shall be a two-dog limit per adult visitor.
(3) 
An adult must accompany children under the age of 16 using the facility.
(4) 
Owners are responsible for:
(a) 
Cleaning up after their dogs.
(b) 
Maintaining control over their dogs at all times.
(c) 
Having a leash at all times.
(d) 
Keeping gates closed at all times.
(e) 
Stopping dogs from digging and fill holes created by their dogs.
(f) 
Not leaving dogs unattended. (Abandonment of animals is prohibited and illegal.)
(g) 
Helping to keep the dog park clean.
(h) 
Any injuries caused by their dogs.
(5) 
Choke collars, shock collars, prong (pinch) collars and spike collars are prohibited for the safety of your dog and other visitors.
(6) 
Any dog over the age of four months must be healthy, vaccinated against rabies and be legally licensed.
(7) 
Dogs may be off-leash in the fenced-in areas only.
D. 
Firefly field. This play area is restricted to use by children 12 years and younger. Firefly Field hours are 7:30 a.m. to dusk. It will be locked at all other times. Firefly Field will also be closed when the Board deems it unsafe for any reason. There will be no wearing shoes with cleats, throwing balls, or rough-housing within Firefly Field's play area. Persons not obeying Firefly Field rules may be restricted from using the facility.
E. 
Veterans Memorial Park and Education Center. Veterans Park is not a play area. It is a place for veterans, family and friends to visit and reflect on veterans' services. It is also designed as a place for children and other visitors to learn about the history of our country and its conflicts. It is part of Airport Park and is subject to the same restrictions as the rest of the Park. Children are expected to have a parent or adult with them when visiting Veterans Park. It is not one of their play areas. Veterans Memorial Park hours are the same as Airport Park, except during special events. No one is to climb on or deface the monuments, pavers, flags, markers or any other object. Nothing in Veterans Park is to be removed or damaged.
F. 
Concession stand. The stand will only be used by persons with a permit issued by the Board.
G. 
Roller-skating arena. The enclosed roller rink is to be used for skating with roller skates only. It may be used as any other facility when it is not reserved by permit by others. There are to be no bikes or skateboards inside the arena. Rules for arena use are posted on the outside of the arena.
Any person who shall violate any provisions of this article shall, upon conviction thereof, be punishable by a fine of not more than $1,000 and costs of such proceedings or, upon default of payment of such fines and costs, by imprisonment in the county jail for a term of not more than 30 days. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
