[HISTORY: Adopted by the Board of Supervisors of the Township of Warrington 4-16-1991 by Ord. No. 91-5 (Ch. 10, Part 1, of the 1995 Code of Ordinances). Amendments noted where applicable.]
The Board of Supervisors of Warrington Township hereby finds:
A.ย 
That the Surgeon General of the United States has called for a ban on the sale of cigarettes by vending machines;
B.ย 
That the Commonwealth of Pennsylvania has banned the sale or furnishing of cigarettes or tobacco in any form to minors under the age of 18;
C.ย 
That the presence of cigarette vending machines permits indiscriminate sales of cigarettes to minors, not preventable by any assured means of enforcement;
D.ย 
That no penalty has been imposed by commonwealth statute upon minors for the purchase of cigarettes; rather, penalties are imposed only on the seller.

A.ย 
No person shall own, operate, rent or permit the use of a cigarette vending machine on premises under his/her control, in the Township of Warrington.
B.ย 
Penalties. Any person, firm or corporation who shall violate any provision of this chapter, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this chapter continues or each section of this chapter which shall be found to have been violated shall constitute a separate offense.
