[HISTORY: Adopted by the Board of Supervisors of the Township of Warrington 8-24-2004 by Ord. No. 04-12 (Ch. 5, Part 4, of the 1995 Code of Ordinances); amended in its entirety 6-13-2017 by Ord. No. 2017-O-07. Subsequent amendments noted where applicable.]

That a certain document, three copies of which are on file in the office of the Township Manager of Warrington Township, being marked and designated as the "International Property Maintenance Code, 2015," as published by the International Code Council, Inc., be and is hereby adopted as the Property Maintenance Code of Warrington Township, Commonwealth of Pennsylvania; for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Township Manager of Warrington Township are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 236-2.
The following sections are hereby revised:
A. 
Section 101.1. Insert: "Warrington Township."
B. 
Section 103.5. Insert: "All permit fees shall be governed by the current fee schedule adopted by separate resolution of the Board of Supervisors, as of the date of the permit application."
C. 
Section 105.4. Revise: "Any person, firm or corporation who shall violate any provision of this code or who shall fail to comply with any of the requirements thereof or who shall erect, construct, install, alter, or repair a building or structure or do work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under provisions of this code, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not exceeding 90 days. Each day that a violation of this chapter continues or each section of this chapter which shall be found to have been violated shall constitute a separate offense."
D. 
Section 112.4. Revise: "Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not more than $1,000 plus costs."

It shall be a violation for any person to fail to comply with a notice of violation or order served in accordance with the Property Maintenance Code of Warrington Township. Upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, the defendant shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fines and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this chapter continues, or each section of the Property Maintenance Code of Warrington Township which is found to have been violated, shall constitute a separate offense. This chapter may be enforced initially by violation ticket (citation); see Chapter 38, Ordinance Enforcement Procedures, Article II, Tickets for Certain Offenses.
