This chapter shall be known as "The Spring Grove Borough Park Rules and Regulations Ordinance."
This chapter shall regulate the activities of persons in any park owned or operated by Spring Grove Borough.
The park shall be open from 1/2 hour before sunrise to 1/2 hour after sunset.
A. 
All reservations and permits will be issued by the Spring Grove Borough Manager or the Spring Grove Regional Parks and Recreation Center Executive Director, and a registration fee of $75 will be required to ensure proper use and care of the property.

B. 
Use of the pavilion and ball fields shall be by permit only.
C. 
Fires are not permitted in the park. Food grilling is permitted but should not be used within 10 feet of the pavilion.
All persons using the park facilities shall protect, wherever possible, wildlife in the park. To accomplish this, the following is prohibited:
A. 
No person shall injure, deface, climb, mutilate, pull up, remove, or destroy any vegetation in the park, whether tree, bush, shrub, vine, fern, flower or fruit.
B. 
No person shall hunt, trap, chase, capture or molest in any manner whatsoever wildlife of any kind or disturb the nests or eggs of birds or fish or homes of animals.
The discharge of any type of firearm, bow and arrow, paint ball gun, air gun, sling shots, fireworks or any other weapon within the limits of the park is prohibited.
Disorderly and/or immoral acts or practices are prohibited, including:
A. 
The possession and/or use of alcoholic beverages or illegal drugs within the park is prohibited.
B. 
No person shall sell, peddle or advertise any tickets, articles or services in the park.
C. 
No person shall be intoxicated, under the influence of illegal drugs, gamble or use threatening, abusive, insulting or indecent language, fight or commit disorderly or immoral conduct of any kind.
D. 
No person shall post, display or distribute any banner or poster of private, commercial or political nature, unless part of an event approved by the Borough Council.
E. 
Offering anything for sale, except by written permission of the Borough Council, is prohibited.
F. 
Parking of vehicles in other than designated areas is prohibited.
G. 
Careless and unsafe operation of any nonmotorized, human-powered equipment, including bicycles, skateboards, etc., is prohibited.
H. 
Trespassing onto adjoining properties without permission of owners of those properties is prohibited.
I. 
Any practices endangering the welfare and safety of others, including the hitting of golf balls or tossing lawn darts and their like, is prohibited.
Dumping of rubbish, trash and littering of any kind is forbidden.
It shall be unlawful for anyone to deface, mutilate, mistreat, abuse, destroy, mark, write or paint upon anything in the park, whether natural or man-made.
Use or operation of motor vehicles in the park is prohibited except in the designated parking areas during the normal hours the parking lots are open. ATVs, snowmobiles, or any two, four, or more wheeled or tracked vehicle, and recreational vehicles are prohibited anywhere in the park, including the parking lots.
Groups with reservations shall have the sole use of designated reserved areas for the duration of the reservation.

A. 
Pets are permitted in the park and must be under the direct control of the owner at all times. Equestrian activities are prohibited.
B. 
Dogs shall be kept on leashes at all times except in designated off-leash areas.
(1) 
Off-leash dogs must be under control by their owners at all times.
(2) 
Dog owners must have a leash in hand at all times. In the event of problems, dog owners should be able to quickly leash and remove their dogs from the premises.
(3) 
Dog owners must remain in the off-leash area and keep their dog in view at all times.
C. 
All dogs must have up-to-date vaccinations prior to entering the park.
D. 
Dogs under four months of age should not enter the park.
E. 
No infants or small children under 48 inches in height are permitted in the off-leash areas. Adults must accompany children under 15 years of age.
F. 
Owners shall be responsible for the behavior of their animals.
G. 
Aggressive dogs are not permitted in the park. Any dogs showing signs of aggression must be immediately removed from the park.
H. 
No human or dog food is permitted in the designated off-leash areas.
I. 
Pet waste must be immediately cleaned up, bagged and placed in designated receptacles.
J. 
Dogs are not permitted to dig; owners shall be responsible to fill in any areas immediately.
K. 
Owners shall open one gate at a time in the double-gated area. The first gate shall be opened and closed before opening the next one to enter the off-leash area.
L. 
Dogs in heat are not permitted in the park.
M. 
Small dog toys are permitted but owners must remove the toys before leaving the park.
N. 
A limit of three dogs per owner are allowed in the park at one time.
O. 
Grooming is prohibited.
P. 
Dogs over 30 pounds are not permitted in the small-dog area. Dogs less than 30 pounds are not permitted in the large-dog area.
A. 
The park is primarily for the use of Borough residents; however, as Borough property, no discrimination shall be permitted between residents of the Borough and visitors from other areas.
B. 
Parents are responsible for the safety and behavior of their children within the park, and no Borough supervision will be available or provided.
C. 
Users of the park shall respect the rights of others and conduct themselves in a manner acceptable and becoming to others. Users of the park are required to follow the directions of Borough employees, or other duly authorized authorities, who are working in or monitoring the park and activities.
D. 
The use of tobacco products including electronic smoking devices is prohibited at all areas within the park.

Any person found guilty of a violation of this chapter shall appear before the Magisterial District Judge and, upon conviction, shall pay a fine of not more than $1,000 and not less than $100 and the costs of prosecution and in default of payment of such fines and costs of prosecution shall be imprisoned for not more than 10 days, provided that each day's continuance of a violation shall constitute a separate offense.
The provisions of this chapter may be enforced:
A. 
By a law enforcement officer instituting proceedings by citation as provided by law; or
B. 
Any person other than a law enforcement officer shall institute a criminal proceeding by filing a complaint with the Magisterial District Judge as provided by law; or
C. 
By any other proceeding now or hereafter authorized by law.
Successor additions, insertions, deletions and changes thereto may be adopted by resolution of the Borough Council.
