This Part shall be known as the "Canton Township Anti-Nepotism Ordinance of 2014."

1. 
The objective of this Part is to prevent nepotism in the hiring of Township employees and/or the award of contracts (especially no-bid contracts). The hiring of a Township employee closely related to a member of the Canton Township Board of Supervisors and/or other Township employee justifiably arouses public suspicion that the employee was hired on the basis of relationship rather than merit. It is also the purpose of this Part to:
A. 
Discourage favoritism.
B. 
Prevent disciplinary problems.
C. 
Inhibit personal cliques.

The following definitions shall apply:
CONTRACT
An agreement where compensation is remitted between two or more persons which creates an obligation to do or not to do a particular work and/or provide services/materials.
EMPLOYEE
Any person employed to fill a position.
RELATIVE
A parent, child, spouse, sister, grandchild, brother, niece, nephew, uncle, aunt, brother-in-law, daughter-in-law, son-in-law, sister-in-law, grandparent, stepson, stepdaughter or first cousin.
SUPERVISORS
Any person who is elected or appointed to the Canton Township Board of Supervisors.

No person shall be employed nor awarded a contract by Canton Township if such a person is a relative to a Canton Township Supervisor and/or any other Township employee.

This Part shall be communicated to all Township personnel and to all other interested parties.

This Part shall not in any manner be effective against any employee hired as of the date of the approval of this Part.

The Township may terminate the employment relationship with an employee who is hired contrary to this Part. Additionally, the Township may petition the court to terminate any contract as set forth in this Part.

This Part shall become effective immediately upon final enactment and shall not be applied retroactively.
