This Part shall be known as the "Canton Township Parking Ordinance
of 2015."

The purpose of this Part is to regulate parking along Township
roads, streets, alleys, etc., and provide penalties therefor.

The following words and phrases, unless the context clearly
indicates otherwise, shall have the meanings given in this section:
A street or highway intended to provide access to the rear
or side of lots or buildings in urban districts and not intended for
the purpose of through vehicular traffic.
The entire width between the boundary lines of every way
publicly maintained when any part thereof is open to the use of the
public for purposes of vehicular travel. The term includes a roadway
open to the use of the public for vehicular travel on grounds of a
college or university or public or private school or public or historical
park.
The halting of a vehicle, whether occupied or not, except
momentarily for the purpose of and while actually engaged in loading
or unloading property or passengers or in order to obey traffic flow
signals or regulations.
That portion of a highway improved, designed or ordinarily
used for vehicular traffic travel, exclusive of the sidewalk, berm
or shoulder even though such sidewalk, berm or shoulder is used by
pedalcycles. In the event a highway includes two or more separate
roadways, the term "roadway" refers to each roadway separately but
not to all such roadways collectively.
A parking permit may be granted by the Township when a resident
must park permanently in the roadway or alley because of physical
handicap or because there is no adequate available off-street parking
and no reasonable place exists to construct off-street parking.
A parking permit may be granted by the Township when a resident
does not have adequate available off-street parking because of a temporary
visitation by nonresident family or invitees.
The halting of a vehicle, whether occupied or not, except
momentarily for the purpose of and while actually engaged in receiving
or discharging passengers.

Every device in, upon, or by which any person or property
is or may be transported or drawn upon a highway, except devices used
exclusively upon rails or tracks.

Except where otherwise provided herein, no person shall park or leave
standing any vehicle on any Township roadway or alley, nor shall any
person park on the traveled portion of any paved Township roadway
or alley.

No person shall park a vehicle within 15 feet of an intersection.
3.
No person shall park a vehicle in an area of the Township which is
identified as a no-parking zone. All such no-parking zones shall be
identified by being posted with no-parking signs or by painting the
curbs and/or pavement in such zones yellow in color.
4.
No person shall park a vehicle within 25 feet of a fire hydrant.
5.
No person shall park, abandon, or leave standing any vehicle within
the roadway of any highway or alley within the Township such that
it obstructs the flow of vehicular traffic within one or more lanes
of the roadway.

It is lawful to park a vehicle on one side of the following Township

Any resident may apply at the Township Building for a permit
for on-street parking for long-term special needs or for a short-term
special occasion. Special needs permits shall be renewed annually
by reapplication to the Township. All permits shall specify the location
and duration of permitted parking. Residents who require a special
needs permit due to handicap may request placement of a "handicap
parking only" sign at required parking spot. The aforesaid sign shall
remain the property of Canton Township and shall be removed upon expiration
or termination of the special needs permit.

Fines for violating this Part shall be as follows:
A.
For the first recorded violation in a single day of § 15-404, Subsection 1, of this Part (parking in roadway) or § 15-404, Subsection 3 (parking in a posted no-parking area), the penalty shall be $25. For the second recorded violation of § 15-404, Subsection 1, of this Part (parking in roadway) at the same location in a single day, the penalty shall be $50; provided, however, that violations of the same provision of this Part may not be recorded or reported more frequently than once every three hours. For the third and each subsequent violation of § 15-404, Subsection 1, of this Part at the same location in a single day, the penalty shall be $100, plus costs.

Whoever fails to pay such penalties to the Township Secretary/Treasurer within seven days shall be subject to the enforcement and penalty provisions of Subsection 3 of this section.

Upon default, any person, upon conviction before the Magisterial
District Justice, shall be punished by paying a fine of not more than
$250, plus costs, and/or being imprisoned in the county jail up to
30 days. In determining what fine shall be levied, the Magisterial
District Justice shall consider whether the defendant's unlawful parking
caused or could have caused a dangerous situation such as impeding
Township or utility vehicles from repairing or clearing the roadway,
obstructing traffic flow in one or more lanes of moving vehicles and/or
impeding movements of an emergency vehicle.

The owner of any vehicle parked in violation of this Part shall
be prima facie guilty of such violation.

The Board of Supervisors may, by resolution, delegate to the
Township Code Enforcement Officer and/or other Township designee the
authority to determine whether a violation exists and to serve such
notice of violation upon the owner/operator as the Supervisors shall,
by resolution, determine.

It shall be the duty of enforcement personnel to report violations
of this Part by recording the following information:

The enforcement officer reporting the violation shall attach to the
vehicle a notice to the owner or driver that the vehicle is parked
in violation of this Part and instructing the owner or driver to pay
the penalties indicated to the Township Secretary/Treasurer within
seven days.
