The following activities are specifically exempt from the permit
provisions of this chapter:
A.
Land disturbances affecting less than 1,000 square feet of ground
surface.
B.
Land disturbance associated with existing one- and two-family dwellings.
C.
Use of land for gardening for home consumption.
D.
Agriculture when operated in accordance with a conservation plan
or erosion and sedimentation control plan approved by the Conservation
District.
E.
Forest management operations which are following the Department of
Environmental Protection's management practices contained in
its publication "Soil Erosion and Sedimentation Control Guidelines
for Forestry" and are operating under an erosion and sedimentation
control plan.

The applicant shall obtain the required land disturbance permit after obtaining the required plan approval as specified in Part 4 of this chapter. This land disturbance permit will be issued by Canton Township concurrently with final subdivision and land development approval.

A modification to an approved stormwater management plan, when required under § 17-406 of this chapter, shall require a new land disturbance permit. The permit shall be issued following approval of the revised plan.

All applications for permits required by this chapter shall be made on forms supplied by Canton Township. Such application shall provide a brief description of the stormwater management controls and the land disturbance activity. This application shall become part of the plan submission required by Part 4 of this chapter.

All land disturbance permits shall expire six months from the date
of issuance unless construction is commenced prior to this date.
2.
A renewal of an expired land disturbance permit may be issued by
Canton Township following a resubmittal of the permit application
form and its approval by the Canton Township Engineer.
3.
The refusal of Canton Township to reissue an expired land disturbance
permit shall contain the reasons for such refusal.

Any permit issued under this chapter may be suspended or revoked
by Canton Township for:
A.
Noncompliance with or failure to implement any provision of the permit.
B.
A violation of any provision of this chapter or any other applicable
law, ordinance, rule or regulation relating to the project.
C.
The creation of any condition or the commission of any act during
construction or development which constitutes or creates a hazard
or nuisance or which endangers the life or property of others.

A suspended permit shall be reinstated by Canton Township when:

A permit which has been revoked by Canton Township cannot be reinstated.
The applicant may apply for a new permit under the procedures outlined
in this chapter.
