Cross Reference: As to alcohol-related offenses involving minors, §600.060.
For the purposes of this Article, the following words and phrases are defined as follows:
CRIMINAL ACT
An act which violates the Statutes of the United States, the Statutes of the State of Missouri or the ordinances of the City of Manchester, including curfew and moving traffic violations.
GUARDIAN
Guardian appointed by court of competent jurisdiction.
MINOR
Any person under the age of seventeen (17).
PARENT
The natural father or mother, or the adoptive father or mother.
PARENTAL NEGLECT
Any act or omission by which a parent fails to exercise customary and effective control over a minor so as to contribute to, cause or tend to cause a minor to commit any criminal act.
It shall be unlawful for any minor under the age of seventeen (17) years to loiter, idle, wander, stroll or to drive or ride in an automobile, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, wharves, docks or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places between the hours of 11:00 P.M. and 6:00 A.M. of the following day, official City time, except on Fridays and Saturdays when the hours shall be 12:00 Midnight to 6:00 A.M. of the following day, official City time; provided however, that the provisions of this Section do not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor. Each violation of the provisions of this Section shall constitute a separate offense.
It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of seventeen (17) years to knowingly permit such minor to violate the provisions of Section 210.1980 of this Article; provided however, that the provisions of this Section do not apply when the minor is accompanied by his/her parent, guardian, or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his/her parent, guardian or other adult person having the care and custody of the minor. Each violation of the provisions of this Section shall constitute a separate offense.
A. 
Any Police Officer finding a minor under the age of seventeen (17) years violating the provisions of Section 210.1980 of this Article shall immediately take such minor child into custody.
B. 
The Police Officer shall retain custody of the minor child until the parent or guardian is located and the child released to him/her. The officer shall also report the violation to his/her superior officer who shall cause a written notice to be served on the parent, guardian or person in charge of such child setting forth the manner in which the Section has been violated.
C. 
Any parent, guardian or person in charge of such child who shall knowingly permit such child again to violate the provisions of Section 210.1980 of this Article, after receiving notice of the first (1st) violation, shall be subject to punishment as provided in Section 100.100 of this Code.
A. 
Except as otherwise provided in this Section, no person twenty-one (21) years of age or younger operating a moving motor vehicle on roads exclusively within the jurisdiction of the City of Manchester, Missouri, by means of a hand-held electronic wireless communication device, shall send, read or write a text message or electronic message.
B. 
The provisions of Subsection (A) of this Section shall not apply to a person operating:
1. 
An authorized emergency vehicle; or
2. 
A moving motor vehicle while using a hand-held electronic wireless communications device to:
a. 
Report illegal activity;
b. 
Summon medical or other emergency help;
c. 
Relay information between a transit or for-hire operator and that operator's dispatcher, in which the device is permanently affixed to the vehicle.
C. 
Nothing in this Section shall be construed or interpreted as prohibiting a person from making or taking part in a telephone call, by means of a hand-held electronic wireless communications device, while operating a motor vehicle on roads exclusively within the jurisdiction of the City.
D. 
Definitions. As used in this Section, the following terms shall have the meanings indicated:
ELECTRONIC MESSAGE
A self-contained piece of digital communication that is designed or intended to be transmitted between hand-held electronic wireless communication devices. Electronic message includes, but is not limited to, electronic mail, a text message, an instant message, or a command or request to access an Internet site.
HAND-HELD ELECTRONIC WIRELESS COMMUNICATIONS DEVICE
Includes any hand-held cellular phone, Palm Pilot, Blackberry®, or other mobile electronic device used to communicate verbally or by text or electronic messaging, but shall not apply to any device that is permanently embedded into the architecture and design of the motor vehicle.
MAKING OR TAKING PART IN A TELEPHONE CALL
Listening to or engaging in verbal communication through a hand-held electronic wireless communication device.
SEND, READ OR WRITE A TEXT MESSAGE OR ELECTRONIC MESSAGE
Using a hand-held electronic wireless telecommunications device to manually communicate with any person by using an electronic message. Sending, reading or writing a text message or electronic message does not include reading, selecting or entering a phone number or name into a hand-held electronic wireless communications device for the purpose of making a telephone call.
E. 
A violation of this Section shall be deemed an infraction and shall be subject to the penalties provided in this Chapter for moving violations.
F. 
The provisions of this Section shall not apply to:
1. 
The operator of a vehicle that is lawfully parked or stopped;
2. 
The use of factory-installed or aftermarket global positioning systems (GPS) or wireless communications devices used to transmit or receive data as a part of a digital dispatch system;
3. 
The use of voice-operated technology; or
4. 
The use of two-way radio transmitters or receivers by a licensee of the Federal Communications Commission in the Amateur Radio Service.
