As used in this Part, the following terms shall have the meaning
indicated:
An on-street person-with-disability parking space installed
in front of a residence of a mobility-disabled resident or as near
to that residence as possible to accommodate the mobility-disabled
resident's mobility limitations. The disabled-only parking space shall
be comprised of blue curb paint and a "Person-With-Disability" parking
sign and post at the parking area or any such other or different designating
characteristics as may be required by applicable law.
A person who demonstrates to the satisfaction of the Borough
Council that the person has a physical disability that affects the
person's mobility to such an extent that it creates a real need for
the creation of a disabled parking space in order for the person to
avoid significant hardship such as permanent or long-term conditions
requiring the use of a wheelchair, artificial limb, crutch, cane,
walker or having a physical disease or condition which makes it very
difficult, medically dangerous or impossible to walk more 50 feet.

1.
A disabled-only
parking space is intended to provide parking in front of or as near
as possible to the front of the residence of a mobility-disabled resident
in a residential high-parking-demand area where such parking in front
of or sufficiently near the mobility disabled person's residence may
not otherwise be readily available.
2.
A disabled-only
parking space is not intended to replace parking in the disabled resident's
driveway or garage where such an option exists.
3.
A disabled-only
parking space is intended to provide parking to mobility-disabled
residents in front of or as near as possible to the mobility-disabled
resident's actual place of residence only.
4.
A disabled-only
parking space is provided as a courtesy to the mobility-disabled resident
and the granting or discontinuing the grant of a disabled-only parking
space shall be made at the sole discretion of the Borough Council.
5.
Each disabled-only
parking space displaces a general parking space that would otherwise
be available to other residents. Accordingly, disabled-only parking
can have a substantial negative impact where residential parking availability
is limited. For this reason, the mobility-disabled resident has the
burden of demonstrating a real and substantial need for a disabled-only
parking space, and such spaces will only be granted by the Borough
Council on a case-by-case basis after balancing the demonstrated needs
of the mobility-disabled resident seeking the granting of a disabled
parking space against the needs of other residents in the area.

1.
If a mobility-disabled resident follows the Borough's application
process and sufficiently demonstrates a need for a disabled-only parking
space to the Borough Council and the Borough Council determines that
the granting of such a space is warranted in a particular case, then
the Borough Council shall grant the request and the Borough shall
install the disabled-only parking space, free of charge, as a courtesy
to the mobility-disabled resident for the exclusive use of the mobility
disabled resident's vehicle.
2.
The Borough Council shall consider the application submitted by the
mobility-disabled resident requesting the disabled-only parking space
and the results of any Borough investigation performed in connection
therewith and will thereupon either approve or deny the application
by vote of the Borough Council at a public meeting.
3.
There is no right to the grant of a disabled-only parking space and
whether to approve or deny an application for a disabled-only parking
space shall in all cases be at the discretion of the Borough Council.
4.
A disabled-only parking space, once-granted, shall be for the exclusive
use of the successful applicant to park the vehicle with the license
plate number the successful applicant identified in his or her application.
5.
The Borough shall have the right to periodically investigate and
redetermine whether a granted disabled-only parking space should continue
to exist and reserves the right to discontinue and remove a granted
disabled-only parking space at any time, at its discretion and without
notice.

1.
Application.
A mobility-disabled resident may request a disabled-only parking space
in front of his or her residence or as near thereto as reasonably
possible by submitting an application to the Borough Secretary on
an application form that can be obtained from the Rankin Borough Secretary
at the Rankin Borough Municipal Building, 320 Hawkins Avenue, Rankin,
PA 15104.
2.
Criteria.
The application shall be in writing and shall set forth or attach
the 'following information:
A.
The applicant
must confirm that the applicant is a resident of the Borough and is
permanently mobility disabled, or will be mobility disabled for a
period of time exceeding one year, or resides with a mobility-disabled
person who is permanently mobility disabled or will be disabled for
a period of time exceeding one year, and the applicant is responsible
for his or her transportation;
B.
The applicant
must attach documentation from a treating physician, confirming that
the mobility-disabled person's mobility is impaired to the extent
that ambulation is severely restricted;
C.
The applicant
must set forth that the requested proposed location of the disabled
parking space is on a public street and that the applicant resides
at the address where the disabled parking space is requested;
D.
The applicant
must supply the vehicle's license plate number and, where a disabled
parking placard has been assigned, the number thereof with expiration
date;
E.
The applicant
must confirm that the applicant or the mobility-disabled resident
residing at the applicant's residence has a currently valid Person
With Disability or Severely Disabled Veteran registration plate on
their vehicle, or has been issued a currently valid Person With Disability
placard;
F.
The applicant
must confirm that off-street parking on the property where the residence
is located or near where the residence is located does not exist or
is inaccessible;
G.
The applicant
must confirm that the requested disabled parking space does not conflict
with any parking restrictions already in place;
H.
The applicant
shall agree to advise the Borough when the disabled parking space
is no longer required.
3.
Borough
Review and Determination: The Borough, acting through its members,
police department, code enforcement officer, Borough Secretary, and/or
such other person(s) it may designate for such purpose shall review
the application and conduct such additional investigation as the Borough
deems appropriate. The application and all follow-up information obtained
by investigation or otherwise shall then be provided to the Borough
Council for its review and consideration. The Borough Council shall
then determine whether to grant or deny the application at the next
regularly scheduled Borough Council public meeting after the application
process and follow-up investigation, if any, is completed.

After
the granting of an application for a disabled-only parking space and
the providing of such a space, the Borough shall conduct such investigations
as it deems necessary or appropriate to confirm that the disabled-only
parking space continues to be needed or properly utilized and may
discontinue and remove a previously granted disabled-only parking
space as it deems appropriate and at its discretion.
2.
Any misuse
or abuse of the granted disabled-only parking space, including but
not limited to failure of the mobility-disabled person for which it
was intended to utilize it and/or failure to regularly utilize it
for the parking of the vehicle identified in the application in it
shall result in the disabled parking space being discontinued and
removed.

A disabled-only parking space shall be distinctively marked
with a sign depicting the international wheelchair symbol or like
symbol and by marking the approximately twenty-two-foot length of
the curb where the parking space is located with blue or red paint.

It shall be unlawful for any person, including a person with
disability, to park or leave standing any vehicle in a disabled-only
parking space unless the vehicle: 1) has a "Person With Disability"
placard or "Person With Disability" or "Severely Disabled Veteran"
license plate issued for that vehicle; and 2) has issued and affixed
to it the license plate number shown or otherwise identified in the
application for the installation of the disabled-only parking space.

Any person violating the provisions of this Part is guilty of
a summary offense and shall, upon conviction, be sentenced to pay
a fine of not less than $50 nor more than $200.

This Part shall take effect as of the date of its enactment
and its coverage shall include disabled-only parking spaces granted
prior to its enactment, which shall immediately become subject to
the provisions of § 16-605 of this Part.
