The following improvements shall be installed by the subdivider
or a suitable guarantee provided by the subdivider which shall ensure

a suitable guarantee is provided.
Streets shall be surfaced to the grades and dimensions drawn
on plans, profiles, and cross-sections submitted by the subdivider
and approved by the Planning Commission. Before paving the street

specifications unless a specific substitute is requested and approved
by the Planning Commission.

and set at all points where lines or lines and curves intersect.
At the time each improvement is to be installed and upon its
completion, the subdivider shall notify the Planning Commission to
this effect so that adequate inspections can be made. A fee of 1 1/2%
of the cost of the required improvements shall be paid to the Planning
Commission to cover the cost of inspection. Any unused portion of
the fee shall be returned to the subdivider.
A.
In lieu of the immediate installation of the improvements, the subdivider
shall provide a performance guarantee. The guarantee must be approved
by the Planning Commission, and filed with the Borough Secretary.
It must:
(1)
Be a bond, certified check, or other satisfactory security.
(2)
Be payable to the Borough in which the subdivision is located.
(3)
Be in an amount sufficient to complete the improvements in compliance
with these regulations.

In the case of cash or its equivalent, be held in an escrow fund.

the inspector, the guarantee must be released and returned. Portions
of the guarantee may be released and returned in amounts commensurate
with the cost of the installed improvements.
C.
Default. In the event the subdivider fails to install the required
improvements in accordance with the final plan, the performance guarantee
is forfeited to the Borough to be used for completion of the improvements.

Maintenance guarantee. In cases where the subdivider installs improvements,
he shall provide a maintenance bond in such amount, under such conditions,
and form and with surety as shall be approved by the Borough to guarantee
the maintenance of the roads, streets, curbs, gutters, sidewalks,
water mains, sewer mains, and storm sewers for a period of not less
than two years from the date of acceptance of the improvements by
the Borough.
