[HISTORY: Adopted by the Borough Council of Montgomery Borough 6-27-1949 by Ord. No. 184 (Ch. I, Part 4B, of the 1996 Code of Ordinances). Amendments noted where applicable.]

There is hereby created a recreation board to be known as the "Montgomery Recreation Board of Montgomery, Pennsylvania."

The Board shall be composed of seven members to be appointed by the Borough Council, except that three of the said seven members may be members or appointees of the school board having control over the school district in which the Borough of Montgomery may be located. Such Board shall possess all the powers, and be subject to all the responsibilities of borough recreation boards as prescribed and set forth in law. Members of the Board shall be appointed for a term of five years, except that, of the seven members first appointed to the Board, the terms of two shall expire at the end of one year, two at the end of two years, one at the end of three years, one at the end of four years, and one at the end of five years. Vacancies shall be filled for the unexpired term in the same manner as the original appointments. Members of the Board shall serve without pay.

The Recreation Board shall appoint from its membership a Chairman and such other officers as it may deem necessary for the orderly procedure of its business, and may adopt rules and regulations governing the conduct of all business within its jurisdiction. The Board shall hold regular meetings at such times and places as it may designate.
The Recreation Board shall supervise the recreation programs and activities and all indoor and outdoor activities and may use the areas and facilities controlled, maintained and operated by the Montgomery Public Park Commission.[1]

Editor's Note: The Park Commission was established and regulated by Ordinance No. 72, mainly to supervise Montgomery Public Park. The Park Commission was abolished by Section 1 of Ord. No. 1973-4, which repealed Ord. No. 72. Section 2 of Ord. No. 1973-4 provided that the Montgomery Park Commission transfer all properties, physical and monetary, to the Borough.

The Recreation Board may accept any gifts, grants, bequests or donation of services, equipment, real estate or money from any individual or group, to be used as specified by the donor, as by the terms of acceptance. The Recreation Board shall have no authority to enter into any contract or incur any binding obligation other than for current obligations or contracts to be fully executed within the then current fiscal year, and within budgeted appropriations made for such year by the Borough Council and any other moneys lawfully appropriated or made available to the Recreation Board for such year.
The Recreation Board shall have the power to appoint an executive director or superintendent of recreation, who possesses the necessary qualifications and who has demonstrated by actual work his ability to organize and direct a community recreation system, and such other personnel as may be deemed necessary and are recommended by the executive director.

The funds appropriated by the Borough Council and budgeted to the Recreation Board shall be disbursed by the fiscal disbursing officer of the Recreation Board, upon vouchers issued by the Recreation Board and within the appropriations made. Funds received by the Recreation Board from sources other than budget appropriations shall be deposited by the fiscal disbursing officer to the credit and for the use of the Recreation Board, and shall be disbursed as the above-mentioned budgeted funds are disbursed, except that funds received as gifts, bequests or donations shall be disbursed in accordance with the terms of such gift, bequest or donation, or the terms of the acceptance thereof.

The Recreation Board shall make full and complete reports to the Borough Council at such times as the Council may designate or request. The fiscal year of the Recreation Board shall conform to that of the Joint School District of the Borough of Montgomery and Clinton Township.
Such powers as are or may be hereafter provided by statute of the Commonwealth of Pennsylvania, or by ordinances of the Borough of Montgomery relating to the development of and supervision of recreation programs and/or recreational activities are hereby vested in the Recreation Board to be exercised by it subject to any and all restrictions contained in such powers and ordinances.
