It shall be unlawful for an owner, tenant or occupier to fail to properly maintain a fire, smoke or burglar alarm system resulting in response by the Montgomery Fire Department or Police Department to a false alarm. For the purpose of this chapter, response by the Montgomery Fire or Police Department to more than one false alarm due to an improperly maintained fire, smoke or burglar alarm system or service in any thirty-day period shall be considered failure to properly maintain such a system or service and violation of this section.
It shall be unlawful for an owner, tenant or occupier to negligently set off a fire, smoke or burglar alarm system or service resulting in a response by the Montgomery Fire Department or Police Department to a false alarm. For the purpose of this chapter, a response to more than one false alarm due to negligently setting off such a system in any thirty-day period shall be considered a violation of this section.
The activation of an alarm system through mechanical failure, malfunction, improper installation, or the negligence of the owner, tenant or occupier or lessee of an alarm system, or his employees or agents, shall be considered a "false alarm" for the purpose of this chapter.

Any person or persons who shall violate any provision of this chapter shall, for every such violation, be sentenced to pay a fine of not less than $50 nor more than $600, and costs of prosecution; and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days. Provided: each day on which any such violation takes place shall constitute a separate violation.
