GENERAL REFERENCES

No person shall indulge in disorderly, noisy, or disturbing practices, as hereinafter defined, within the Borough of Montgomery. Any adult or minor person who commits any of the following acts shall be deemed in violation of this section:
A. 
Obscene language, conduct, behavior. Uses or indulges in obscene language, conduct or behavior.
B. 
Annoys, disturbs others. Acts in such manner as to maliciously, with malice aforethought, annoy, disturb, interfere with, obstruct or be offensive to others.
C. 
Shouts, makes noises. Shouts or makes any other noise either outside or inside a building during the nighttime to the annoyance or disturbance of any person or persons.
D. 
Tampers with municipal property. Maliciously damages, destroys, or makes improper or unauthorized use of any municipal property, including parks, parking lots, signs and notices, or conducts himself or herself in a manner contrary to any notices, rules or regulations of the Borough, or refuses to obey orders of any persons in authority with respect to the use of, or conduct in, or with respect to, such property.
E. 
Disturbs peace and quiet. Disturbs the peace and quiet of the Borough of Montgomery or any lawful meeting or assembly therein.
F. 
Prowls or loiters. Whosoever at nighttime maliciously loiters or maliciously prowls around a dwelling house, public building or any doorways, stairways or areas adjacent thereto within the Borough.
G. 
Fighting. Engages in fighting or in violent behavior, contrary to the public welfare, health and safety of the citizens of the Borough of Montgomery.
H. 
Public drunkenness. Appears in any public place or thoroughfare in the Borough of Montgomery so manifestly under the influence of alcohol as to constitute a danger to himself or herself, or a danger or annoyance to the person or property of others.
I. 
Noisy operation of a motor vehicle. Operates a motor vehicle in such a condition or in such a manner so as to cause any excessive, unusual or avoidable noise, including the operation of a vehicle in turning corners at an excessive speed or in starting from a standing position at an excessive speed causing the tires thereof to squeal.
J. 
Congregating, loafing and making unnecessary noise prohibited. Whoever shall wilfully congregate or loaf on the streets, sidewalks or public parking areas of the Borough of Montgomery, or congregate or loaf in cars or vehicles parked in the streets, public parking areas, or public highways of said Borough, and blow horns, play radios or tape recorders or make any loud, boisterous and unseemly noise or disturbance, to the annoyance of the peaceable inhabitants nearby or near to any public highway in said Borough, shall be guilty of disorderly conduct and the same is hereby declared to be a nuisance.
K. 
Loitering. No person shall loiter in or about any public building, doorways, stairways or areas adjacent thereto or any other area which is open and accessible to public. For the purposes of this subsection, "loitering" shall be defined as remaining in or about an area when the person is not conducting any legitimate activity within said area.

Any person, firm or corporation who or which engages in, is connected with, commits or is guilty of any of the acts prohibited by this chapter shall be guilty of an offense, for every such violation, and, upon conviction, shall be sentenced to pay a fine of not less than $25 nor more than $600 and costs of prosecution, and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days, and any organization or corporation which permits or allows any provision of this chapter to be violated shall likewise be guilty of an offense and, upon conviction, shall be subject to the same penalty as above prescribed in this section.
