The owner, occupant or tenant of every property fronting upon or alongside of any of the streets in the Borough of Montgomery is hereby required to remove or cause to be removed from all of the sidewalks in front of or alongside of such property all snow and ice thereon fallen or formed, within 10 hours after the same shall have ceased to fall or to be formed. Provided: snow or ice that has ceased to fall or to be formed after 6:00 of any evening may be removed at any time before 10:00 of the next morning. Provided further: the owner of a property shall be responsible for conforming to the requirements of this section where such property is occupied by such owner or is vacant or unoccupied or is a multiple-business or multiple-dwelling property, occupied by more than one occupant or tenant; the occupant or tenant of a property shall be responsible therefor where such property consists of a single rental unit, occupied by one tenant or occupant only.[1]

It shall be unlawful for any owner, occupant, tenant, association, partnership or corporation to throw, deposit, discharge, or cause to be thrown, cast, blown or deposit any snow, ice, hail or sleet into any plowed streets, alleys or public highways situate within the Borough of Montgomery.

Any owner, occupant or tenant, as the case may be, who fails to remove any snow, and/or ice from any sidewalk, as required in § 397-1 of this article, shall be guilty of an offense and, for every such offense, upon conviction, shall be sentenced to pay a fine of not more than $50 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days. Provided: The imposition of one penalty under this section shall not excuse the offense or violation or permit it to continue, and each day on which the prohibited conditions are continued or maintained shall constitute a separate offense. Provided further: The imposition of the penalty shall not be held to prevent the enforced removal of prohibited conditions by authority of the Borough and the collection of the cost of the removal from the violator.

Any owner, occupant, tenant, association, partnership or corporation who or which violates any provision of § 397-2, by depositing snow and/or ice onto any plowed street or alley, shall be guilty of an offense and, for every such violation, upon conviction, shall be sentenced to pay a fine of not less than $25 nor more than $600 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for more than 30 days. Provided: each day's violation of any such provision shall constitute a separate offense.
