This article shall be known and may be cited and referred to as the "Street Numbering Ordinance of the Borough of Lavallette."
The purpose of these regulations is to adopt a system of numbering and provide for the mechanism to change assigned numbers from time to time as deemed necessary by the governing body and to require the clear display of authorized and assigned street numbers on every building fronting on any street in the Borough of Lavallette in order to assist the general public and emergency services, public and private, in identifying any property in case of emergency or otherwise.
All residential, commercial, industrial or other structures erected or to be erected within the Borough of Lavallette shall display identification numbers in conformance with the street numbers on the official records of the Borough as they appear on file in the office of the Tax Assessor of the Borough and as provided herein and in accordance with the specifications provided herein.
A. 
Street numbers shall be determined and assigned by the Borough of Lavallette and shall be consistent with the guidelines contained in N.J.S.A. 40:23-50. Street numbers shall be placed on the official maps and allotted to the owner of each lot by the Tax Assessor or such other person as may be designated from time to time by resolution of the Borough Council. When assignment of a number takes place, all property owners shall take due notice thereof and shall comply with the provisions of this article. The Tax Assessor or such other person as may be designated shall also have the power and duty to correct any errors with respect to assignment of street numbers.
B. 
Every owner, occupant or lessee of a building constructed or to be constructed in the Borough of Lavallette shall apply to the Tax Assessor if no number has been previously assigned for an authorized number in accordance with this article.
The owner or association in control of each condominium or apartment complex or similar multibuilding complex shall place upon the outside of each building and/or unit in said complex, in a location and format approved by the Borough, the number and name of each such building.
Notwithstanding the preceding § 56-29, any owner or occupant of property may apply to the Tax Assessor, who shall furnish them with the correct street number assigned to such property.
A. 
In order to facilitate the renumbering of the buildings and land fronting on the streets and highways of the Borough of Lavallette, in accordance with the provisions of this article, the renumbering shall be effected by the application of the provisions hereof to one or more streets in the Borough, from time to time, in accordance with the selection or designation of a street or streets by the Borough Council, which Council is hereby authorized and empowered to determine and designate when a street or streets shall be renumbered.
B. 
The Borough Engineer, under the direction of the Council, shall provide a street numbering map or maps designating thereon proper numbers in accordance with the provisions hereof and, when the maps are prepared, shall mail or deliver to each property owner a written notice, advising the owner of the number or numbers to be applied to the owner's building or property and fixing a date when such new number shall be attached to the owner's building or buildings, in accordance with the provisions of this article.
C. 
Any property owner of property within the Borough of Lavallette may make application through the office of the Tax Assessor to the Borough Council for renumbering of their property, in accordance with the terms of this article for reasons of clarity in numbering and identification of the particular property.
(1) 
An application fee of $25 shall accompany the request for renumbering.
(2) 
Renumbering shall be consistent with the numbering scheme on the street to which the numbering shall refer upon any approved change.
(3) 
Renumbering of the property shall not affect or impact any other numbers of any other properties on the street to which the numbering shall refer upon any approved change.
In case of difficulty in applying the plan or system of numbering provided for in § 56-32 of this article as applied to the renumbering on occasion of any entire street, or portions thereof, the Tax Assessor shall adjust the same by assigning numbers which will implement numbers consistent with this article.
The Tax Assessor and Borough Engineer shall be responsible for assigning proper number sequences to each lot which is created as the result of a subdivision or resubdivision. Said number shall be in proper municipal sequence in relation to the number assigned to other lots fronting on the same street and shall be properly recorded on the Official Map of the Borough.
House or building identification numbers shall be:
A. 
In Arabic numerals.
B. 
A minimum height of three inches.
C. 
Mounted in a secure fashion to the front wall or porch of the building so as to be clearly visible from the street.
D. 
Sufficiently legible as to contrasting background, arrangement, spacing and uniformity so as to be clearly visible from the street.
E. 
At least 30 inches above ground level and so placed that trees, shrubs and other obstructions do not block the line of sight of the numbers from the street upon which the building fronts.
If numbers affixed to the front of the building would not be visible from the street as required in § 56-35, requirements of this article are satisfied if the owner, occupant or lessee shall provide the Arabic numbers, as required by § 56-35, upon a post, rod or other type of fixture of substantial nature or a mailbox at or near the road frontage with the same number affixed thereon and so located upon the same, so that the number may be conspicuous and visible from the street upon which the building fronts. When the provisions of this section have been complied with, the owner, occupant or lessee of the house or building shall not be otherwise obligated to affix Arabic numbers to said house or building and shall be permitted, at his option, to utilize cursive numbers or no numbers at all upon the house or building.
The absence of house or building identification numbers, the insecure fastening or absence of any integers thereof, the use of any number not assigned by the Tax Assessor, the attempt to comply by using the numbers on or attached to a mailbox or the failure of a number to meet the elevation or visibility requirements hereof shall be considered a violation of this article. Failure on the part of the property owner to comply with the provisions of this article within a period 15 days from the date of issuance of a notice of violation shall be sufficient cause for the Tax Assessor, the Code Enforcement Officer, Fire Inspector, or a police officer to issue a summons for violation of this article. Any person, firm, corporation or other business entity convicted of a violation of the provisions of this article shall be fined $50 for the first offense and $100 for subsequent offenses. For the purposes of this article, it shall be considered a separate violation for each calendar quarter of noncompliance.
Any structure erected, repaired, altered, modified or transferred by sale after the effective date of this article shall have the certificate of occupancy withheld until it is assigned a house number and said number is affixed to said structure in accordance with this article.
