A. 
The City, through its attorney, will defend and indemnify, to the fullest extent allowed by law, subject to the limitations imposed by the Constitutions of the United States and the State of Missouri, in any legal proceeding in which they are alleged to have committed acts within the course of their employment or governmental service its Council members, officers and employees in their official and individual capacities, unless and until said Council members, officers, employees and volunteer members of boards and commissions are finally adjudicated by a judicial court of last resort to have acted maliciously, or to have acted outside the course and scope of their employment of service to the City. Further, it is ordained that the Mayor of the City is hereby authorized to pay all of said costs consistent with this resolution. However, the City may at any point in the future place a limit on the amounts expended pursuant to this Article if it is determined by the City Council that said costs are excessive.

Persons who elect to hire a private attorney must do so at their own expense.

This Section does not pertain to formal hearings or any other proceeding in which elected or appointed officials make allegations on behalf of the City against City Officials, City employees or volunteer members of City boards or commissions.
