(a) 
All words and phrases used in this section shall be construed and have the same meanings as those words and phrases defined in Act 303, P.A. 1967, as amended, M.S.A. 18.1287(8).
(b) 
Regulation No. 80, Van Buren County; R 281.780.9 Lake Brownwood, hours for high-speed boating.
Rule 9. On the waters of Lake Brownwood, §§ 34 and 35, T2S, R14W, Waverly Township, Van Buren County and §§ 2 and 3, T3S, R14W, Paw Paw Township, Van Buren County it is unlawful between the hours of 6:30 p.m. and 10:00 a.m. of the following day for the operator of a vessel to:
(1) 
Operate a vessel at high speed.
(2) 
Have in tow or otherwise assist in the propulsion of a person on water skis, water sled, kite, surfboard, or other similar contrivance.
(c) 
All other ordinances or parts of ordinances in conflict herewith are hereby repealed.
(d) 
Any person, firm, association, partnership, corporation or governmental entity who violates any of the provisions of this chapter shall be deemed to be responsible for a municipal civil infraction as defined by Michigan Statute which shall be punishable by a civil fine determined in accordance with the following schedule:

*Determined on the basis of the date of commission of the offense(s).
Additionally, the violator shall pay costs which may include all expenses, direct and indirect, to which the Township has been put in connection with the municipal civil infraction. In no case, however, shall costs of less than $9 or more than $500 be ordered. In addition, the Township shall have the right to proceed in any court of competent jurisdiction for the purpose of obtaining an injunction, restraining order, or other appropriate remedy to compel compliance with this article. Each day that a violation exists shall constitute a separate offense.
