The City Marshal shall be elected to his/her office by the people of the City, as provided by law.

The City Marshal, before entering upon the discharge of the duties of said office, shall take and subscribe to the official oath required by the ordinances of the City and shall give bond to the City in the sum of five hundred dollars ($500.00), with not less than two (2) solvent sureties who are residents of Scotland County, Missouri; which bond shall be conditioned, approved or disapproved, filed and kept as required by the ordinances of the City.

The Marshal shall be a conservator of the peace and shall be active and vigilant in the preservation of good order in the City and in the enforcement of its ordinances. He/she shall be the Marshal of the City and may, at all times, make or order an arrest, with proper process, for any offense against the ordinances of the City; and he/she may keep the offender in the City Jail to prevent his/her escape until a trial can be had or until said offender given bond for his/her appearance for trial as provided by law; and he/she shall make arrests without process in every case in which said offense is committed in his/her presence.

The Marshal is the Director of the Police Department. He/she shall have immediate and direct control of the department, subject to the supervision of the Mayor, and subject to such other rules, regulations and orders as the Mayor may prescribe. He/she shall promulgate and enforce orders, rules and regulations (consistent with this Code and with the rules, regulations and orders of the Mayor) for the efficient operation of the Police Department.

The Marshal shall devote his/her entire time to the discharge of his/her official duties.

The City Marshal may, by and with the consent and approval of the Board of Aldermen, appoint one (1) or more deputies, for whose action and conduct as such he/she shall be responsible on his/her official bond, and who shall be subject to his/her orders and have the same authority to make arrest and serve process, orders and notices as is vested in said Marshal; and said deputies shall hold office at the pleasure of the Marshal and shall at all times be active and vigilant in enforcing and preserving law and good order in the City.

The City Marshal shall, upon making an arrest, forthwith cause the person arrested to be brought before the Associate Circuit Court Judge, except when said person is violent, intoxicated or in such condition as to be unfit to be brought into court, and except when said arrest is made on Sunday or after the usual business hours of the day; and, in the event of said exceptions, or either of them, the City Marshal shall confine said person so arrested in the City Jail or other proper place until said exception does not exist.

The City Marshal is hereby authorized and directed to execute all process, orders and notices issued in conformity to the ordinances of the City, and for the purpose his/her authority shall be coextensive with the limits of Scotland County, Missouri.

Whenever the City Marshal shall find an obstruction in any highway in the City, he/she shall forthwith give to the person who placed said obstruction in said highway oral notice to immediately remove the same from said highway; and if, after notice as aforesaid, said person shall fail, neglect or refuse to remove said obstruction from said highway within a reasonable time, or if the person who placed said obstruction in said highway is unknown to the Marshal, then the Marshal shall remove the obstruction from said highway.

A. 
The City of Memphis, Missouri, participates in the formation of a Major Case Squad with other governmental units located in Adair, Chariton, Clark, Lewis, Knox, Macon, Marion, Monroe, Ralls, Randolph, Schuyler, Scotland, Shelby and Pike Counties to be known and designated as the "Northeast Missouri Major Case Squad."
B. 
The Marshal of the City of Memphis, Missouri, be and is hereby authorized and directed on behalf of the City of Memphis to execute any and all documents necessary in order to form and participate in such Major Case Squad pursuant to Section 70.835, RSMo.
