This Part shall be known as the "Tenant Registration Ordinance."

This Part is enacted pursuant to the authority conferred by the Second Class Township Code, Act 1995-60 of 1995, November 9, P.L. 350, No. 60, § 1, as amended, 53 P.S. § 65101 et seq.

1. 
Every person owning property within the Township which is rented, in whole or in part, to one or more persons for residential purposes shall provide to the Township Secretary a certified list of all tenants who are over 18 years of age and their respective addresses (hereinafter referred to as "tenant registration list") on or before January 31 of each year. The tenant registration list shall be on a form provided by the Township and be available at the Township office located at Lower Mount Bethel Township, P.O. Box 257, Martins Creek, PA 18063.

In addition to the requirement of the aforesaid filing, every such owner of real estate shall file a new tenant registration list within 30 days from the date of any change in person or entity renting or leasing or residing at the subject premises.

For the purpose of this Part, the fact that an owner of real estate rents or leases any property for minimal or no rent to another person or entity shall not excuse the said owner from filing the tenant registration list.

Any person or entity who fails to comply with any or all of the requirements or provisions of this Part, or who fails or refuses to comply with any notices, order, or direction of the Township, or any other authorized Township employee, shall, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Any person who violates this Part shall also be liable for all costs and expenses incurred by the Township in the enforcement of this Part including, but not limited to, court costs and reasonable attorneys fees. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense. Likewise, each section of this Part which is found to be violated shall be considered a separate offense.

Any person owning property within the Township which is rented to one or more persons for residential purposes who willfully or negligently fails to submit a tenant registration list as required by this Part shall be liable for, in addition to other penalties herein provided, such sums as would have been collected by the Township if such tenant registration list had been provided less any sums actually received from such tenants for the fiscal year for which the list was not provided.
