The within article is adopted for the purpose of providing financial
assistance to the Township by helping to recapture some of the Fire
Department expenditures from those recipients receiving the benefit
that have house insurance which covers fire runs.
The recipient of any fire run, with the exception of those mentioned
below, shall be charged for payment from his or her insurance carrier
for those charges that can be recaptured by the recipient from his
or her insurance carrier.
All of the foregoing charges shall be sent to the recipient
of the fire run for his or her issuance to his or her insurance carrier
as a claim against his or her policy. Payment would be expected within
60 days whenever possible.
The following properties and services shall be exempt from the
foregoing charges:
The foregoing rates and charges shall not be exclusive of the
charges that may be made by the Township for the costs and expenses
of providing fire protection services, but shall only be supplemental
thereto. Charges may additionally be collected by the Township through
general taxation after a vote of the electorate approving the same
or by a special assessment established under the Michigan statutes
pertinent thereto. General fund appropriations may also be made to
cover such additional costs and expenses.
When a particular service rendered directly benefits more than
one person or property, the owner of each property so benefited and
each person so benefited where property protection is not involved
shall be sent the charges for issuance to his or her individual insurance
carrier. The interpretation and application of the within section
is hereby delegated to the Township Clerk and shall be administered
so that charges shall only be collected from those recipients of the
service with the insurance that covers such services.
