Public Officers Law § 3 and Village Law § 3-300
require that a local public officer be a resident of the political
subdivision or municipal corporation of the state for which he or
she shall be chosen or within which his or her official functions
are required to be exercised. The purpose of this article is to authorize
a person who is a nonresident of the Village of Chatham to hold any
nonelective appointed Village of Chatham public office, provided such
person resides in Columbia County, New York.
Under Municipal Home Rule Law § 10 and under Village
Law § 3-300, the Village of Chatham has the authority to
authorize a non-Village resident to hold a nonelective appointed Village
of Chatham public office, so long as such person resides in Columbia
County, New York.
With respect to all non-elective public officers employed by
the Village of Chatham (e.g., Village Clerk, Village Treasurer, Village
Chief of Police, etc.) the provisions of Public Officers Law § 3
and Village Law § 3-300, requiring a person to be a resident
of the political subdivision or municipal corporation of the state
for which he or she shall be chosen or within which his or her official
functions are required to be exercised, shall not prevent a person
from holding any nonelective appointed Village of Chatham public office,
provided that such person resides in Columbia County, New York.
