There shall be created in the City of Plattsburgh a commission to be known as the "City Planning Commission." The said Commission is hereby created is so created under and by virtue of the General Municipal Law, Article 12-a, §§ 234 and 239-a, both inclusive.

The Planning Board shall consist of five regular members and two alternate members. The alternate members shall serve only in the absence of a regular member, or where a regular member is unable to vote on a matter due to conflict of interest considerations.

The Mayor shall appoint the regular and alternate members of the Planning Board, subject to confirmation by the affirmative vote of three members of the Common Council. The Mayor shall attempt to appoint at least one regular member or alternate member from each ward. The Planning Board shall elect annually a chairperson from its own regular members. No member of the Common Council or the Zoning Board of Appeals of the City of Plattsburgh shall be eligible for appointment to the Planning Board. A Board member may be removed from office by vote of the Common Council if he or she fails to attend five or more Board meetings out of 12 consecutive regular or special meetings of the Board. The terms of regular and alternate members shall expire on December 31st in the year when the term for which they were appointed expires. A member whose term expires may continue to serve until a successor is appointed. A person who is appointed to fill a vacancy shall serve until the expiration of the term of the person who vacated the position. The term of a member shall be five years; however, if two or more terms expire in the same year, appointments to one or more of the regular positions shall be made for less than five years so that one position becomes vacant every five years. A quorum shall consist of a majority of the whole Board.

A. 
The Commission shall have the power and authority to employ experts, clerks and a secretary and to pay for their services and such other expenses as may be necessary and proper, not exceeding, in all, the annual appropriation that may be made by the City of Plattsburgh for said Commission.
B. 
Pursuant to § 27 of the General City Law, the City Planning Commission is hereby invested with the powers and duties as specified for a Planning Board as provided in Article 3 of the General City Law, in addition to the powers and duties as specified in Article 12-a of the General Municipal Law.
C. 
The Planning Board bylaws are set forth in Schedule I[1] to this chapter, which Schedule I may be amended from time to time by the Common Council through their legislative process.
