It shall be unlawful to engage in the business of removing trees or stumps or of trimming trees on private property within the corporate limits of the City of Plattsburgh, New York, without first having obtained a license therefor.

The Common Council of the City of Plattsburgh may, by resolution, establish or amend the fees and charges to be imposed for the licenses issued hereunder and may determine the period such licenses shall be issued for.

A written application for a license shall be made to the City Clerk of the City of Plattsburgh, New York, and shall be accompanied by proof of the existence of public liability insurance from an insurance company licensed to do business in the State of New York insuring the applicant against loss or damage in the amount of at least $1,000,000 combined single limit for personal injury or death or property damage. The City of Plattsburgh shall be included as a named insured on any such policy of insurance.
It shall be unlawful for any person, firm or corporation to indiscriminately fell or drop trees, limbs or other debris or sawdust on the public streets or sidewalks of the City of Plattsburgh.

All members of the Police Department of the City of Plattsburgh shall enforce the provisions of this chapter, and in the event of a violation, the person, firm or corporation in violation shall immediately cease the work and obtain the license required by § 326-3 of the chapter and furnish the proof of public liability insurance required as a condition for obtaining the license as a condition to continuing the work.

A. 
Any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be fined not less than $25 nor more than $250 or shall be imprisoned for a term not to exceed 15 days, or both, for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues; and in the event that the violation is a failure to obtain a license or a failure to obtain or maintain insurance, the sentence of the court shall also require that the person, firm or corporation in violation obtain a license as provided in § 326-3, including the furnishing of insurance.
B. 
The failure or refusal of a business intending to continue in the business of removing trees or stumps or of trimming trees on private property to obtain such license within one week of the date of conviction and imposition of sentence shall constitute a further violation of this chapter, and the person, firm or corporation so failing or refusing shall be fined as provided in Subsection A above.
