It shall be unlawful for any person engaged in a business, including but not limited to retail, commercial, industrial and manufacturing establishments, to remain open for business during the period from 12:00 midnight to 5:00 a.m., except those as set forth in § 109-2 hereof.
A. 
This article shall not apply to offices for business or professional use, hotels, restaurants where food and beverages are consumed primarily on the premises and any business establishment licensed to sell alcoholic beverages at retail for on-premises consumption.
B. 
This article shall not apply to work performed in a retail establishment as part of the daily opening or closing of the establishment when it is not open for business to the public.
Each day a sale is conducted in violation of this article shall constitute a separate violation, and any person allowing, permitting or engaging in the continuation of the offense may be punished as follows:
A. 
By a fine of not more than $2,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of a first offense.
B. 
By a fine of not more than $5,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of a second offense, provided the first and second offenses were committed within a period of five years of each other.
C. 
By a fine of not more than $10,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of the third or subsequent offense or a series of offenses, all of which were committed within a period of five years.
