Editor's Note: This ordinance also repealed former Ch. 3.08,
Destruction of Public Records, , adopted by Ord. No. 020, Series 2005,
as amended.
The Village hereby adopts, by reference, the Wisconsin Municipal
Records Schedule ("Municipal Records Schedule"), approved by the State
of Wisconsin Public Records Board on August 27, 2018. A copy of the
Records Schedule will be kept on file in the Village Clerk's
office located at 860 Badger Circle, Grafton, WI 53024 and made available
for public viewing during Village Hall hours. The Municipal Records
Schedule will apply to the retention of any Village record that falls
under the scope of the Municipal Records Schedule and which is not
subject to either the Library Records Schedule or the Water Utility
Records Schedule.
The Village hereby adopts, by reference, the General Records
Schedule for Wisconsin's Public Libraries and Public Library
Systems and Related Records ("Library Records Schedule") approved
by the State of Wisconsin Public Records Board on June 12, 2017 for
any record of the U.S.S. Liberty Memorial Public Library that falls
within the scope of the Library Records Schedule.
The Village hereby adopts, by reference, the records retention
regulations for electric, natural gas, and water utilities ordered
by the Public Service Commission in Docket No. 05-US-114, and the
records retention requirements set forth in Wis. Admin. Code § PSC
185.19 (collectively, the "Water Utility Records Schedule") for any
record of the water and wastewater utility that falls within the scope
of the Water Utility Records Schedule.
In the event the Village creates a record not contemplated by
any of the records schedules adopted in this chapter, the Village
may, subject to the Records Board's prior approval, either adopt
an applicable records retention schedule set forth by the Records
Board, if available, or create its own retention schedule pertaining
to the record.
Notwithstanding any other provision of this chapter, if a specific
retention period of any record is governed by the Wisconsin Statutes,
the statutory time period shall control.
All ordinances, or portions thereof, and resolutions, or portions
thereof, in conflict with any portion of this chapter are hereby repealed.
Any approved Village retention schedule, or portion thereof, for any
record not contemplated by any of the records schedules adopted by
this chapter shall remain in full force and effect.
