As used in this chapter, the following words and phrases shall
have the meanings ascribed to them in this section:
A condominium unit in a development in which each unit is
individually titled and bought and sold on an individual basis.
Has the meaning specified in § 289.01(33) Wis.

No person shall deposit, throw, scatter or place any garbage
or other refuse on or within any public street, alley, park, sidewalk
or other public place or within or upon any private property or premises,
whether owned, kept or controlled by such person or not, except in
the manner provided in this chapter or as directed by the Police Department
for the health, safety and welfare of the Village.

A.
All waste shall be placed in the Village-provided refuse cart and
placed at the curb for collection on the designated collection day.
B.
Village collection. The Village will provide curbside collection
of solid waste for the following classifications of property:
1.
One-, two-, three- and four-family residential buildings.
2.
Single-dwelling condominium units.
3.
Nonresidential properties, regardless of the number of tenants (business
and/or residential), that generate no more than two refuse carts per
week.
4.
Where the placement of appropriate containers on site is impractical,
the Village may, upon request, provide curbside collection to four-family
or larger apartment buildings. The cost of said collection for four-family
or larger apartment buildings shall be paid by the property owner
on an annual basis. The rate charged shall be the Village's actual
contract cost for solid waste and recycling collection.
C.
All four-family and larger apartments, condominium developments,
and nonresidential properties initially occupied after January 1,
1995, shall provide for on-site storage of solid waste in appropriate
containers to be approved by the Plan Commission at the time of site
plan approval.

Dumpsters shall be kept closed with covers (except when being
filled or emptied) and shall be kept in a sanitary condition.

All refuse carts shall be placed adjacent to the street, three
feet away from any other object, adjoining the property, by 7:00 a.m.
of the pickup day, but not more than 12 hours prior to collection.
Containers must be removed from the curb within 12 hours after collection.
The collection and disposal of garbage and refuse shall be conducted
under the supervision, direction and control of the Director of Public
Works, subject to the provisions of this chapter and such additional
rules and regulations as may be made from time to time by the Village
Board.
Garbage and refuse shall be collected once each week in the
residential, industrial and commercial districts.
The cost of collection shall be borne by the Village and charged
to the general fund.
The Director of Public Works or his employees or agents may
refuse to collect any garbage or refuse improperly prepared or deposited
for pickup as provided by this chapter.
All collection equipment shall be as approved by the Village
Board, and garbage collection trucks must be completely enclosed and
kept clean and sanitary.

It shall be the duty of the Village Police Chief to strictly
enforce the provisions of this chapter and see that all violations
thereof are promptly abated and violations prosecuted, and it shall
be the duty of the Director of Public Works and all police officers
to give attention throughout the Village to any case of violation
of this chapter and promptly report the same to the Village Health
Inspector.

Any person who violates this chapter shall, upon conviction
thereof, forfeit not less than $200 nor more than $500, together with
the costs of prosecution. In the event of a failure to pay such forfeiture,
where no showing of indigence is made, the defendant may be imprisoned
for no more than 90 days, as the court deems fit or until such judgment
is sooner paid.

Any person who dumps or disposes of any garbage, as defined by § 8.20.010, rubbish, brush, refuse or other such material at the Village yard in violation of this chapter, or causes the same to be done, unless authorized by the Director of Public Works, shall, upon conviction thereof, forfeit not less than $200 nor more than $500, together with the costs of prosecution. In the event of a failure to pay such forfeiture, where no showing of indigence is made, the defendant may be imprisoned for no more than 90 days, as the court deems fit or until such judgment is sooner paid.
