The use of tobacco products has been shown to be hazardous to one's health. The purpose of this chapter is to provide a safe and healthy environment for members of the public and all employees of the Village of Grafton by regulating the use of these products in municipal buildings.
The following definitions shall apply to this chapter:
- Shall be defined as indicated in § 139.30(1m), Wis. Stats., and shall mean any roll of tobacco wrapped in paper or other substance other than tobacco.
- To smoke or carry a lighted pipe, cigar or cigarette or a tobacco product as outlined herein in any form.
- TOBACCO PRODUCTS
- Cigars, cheroots, stogies, periques, granulated, plug cut, crimp cut, ready-rubbed and other smoking tobacco, cavendish and twisted tobacco, fine cut and other tobaccos, shorts, refuse scraps, clippings, cuttings and sweepings of tobacco and other kinds and forms of tobacco prepared in such a manner as to be suitable for smoking in a pipe or otherwise. "Tobacco products" does not include cigarettes, as defined under § 139.30(1m), Wis. Stats.
Smoking, as defined in § 9.36.020 of this chapter, shall be prohibited in the following municipal facilities:

Department of Public Works, 1300 Hickory Street.
Family Aquatic Center, 649 North Green Bay Road.
Multipurpose Senior Center, 1665 Seventh Avenue.
Police Department, 1981 Washington Street.
U.S.S. Liberty Memorial Public Library, 1620 Eleventh Avenue.
Village Hall, 1971 Washington Street.
Water and Wastewater Utility, 1900 Ninth Avenue.
Robert P. Zaun Pavilion, Lime Kiln Park, 2020 S. Green Bay Road.
The prohibition on smoking shall become effective on January 1, 2008, and shall apply to the members of the public and all existing employees of the Village of Grafton as well as all perspective employees upon their application for employment.
Signs prohibiting smoking shall be prominently posted at or near the entrance to the municipal facilities listed in § 9.36.030.
The person in charge of each building or structure shall be held responsible for the enforcement of the regulations in this chapter.
It shall be unlawful for any person to remove, deface or destroy any legally required "No Smoking" sign or to smoke in any place where a "No Smoking" sign is posted.
Members of the public who violate any provisions of this chapter shall, upon conviction thereof, forfeit not less than $50 for the first offense and not more than $100 for the second and subsequent offenses, together with the costs of prosecution.
Employees of the Village of Grafton who violate any provisions of this chapter shall be subject to disciplinary action.
The employee's supervisor shall identify the violation and notify the employee in writing of said violation.
The form of disciplinary action to be taken (oral warning or written reprimand) and the penalty assigned (warning or suspension for multiple violations) shall be at the discretion of the supervisor upon consultation with the department head and Village Administrator.
