[HISTORY: Adopted by the Board of Commissioners of the Town of West New York 7-20-2017 by Ord. No. 18/17. Amendments noted where applicable.]
WHEREAS, N.J.S.A. 40:54-9 provides that the Town of West New York ("Town") may establish a library board of trustees consisting of seven to nine members; and
WHEREAS, the Town presently has a Library Board of Trustees ("Library Board") that is composed of seven members, as set forth in the Manual of the Board of Trustees of the Free Public Library of West New York (adopted May 16, 1917); and
WHEREAS, the Town seeks to increase Library Board membership to nine members, as among other things, this will lead to increased community involvement and participation:
The West New York Public Library shall be under the management of a Board of Trustees, to be known as the "Library Board of the West New York Public Library" ("Library Board").
The Library Board shall be composed of nine members, who shall be appointed in the manner set forth in N.J.S.A. 40:54-9.
Members of the Library Board shall receive no compensation.
The Library Board shall have such powers and duties as provided by law.

In the case of a member Library Board, such member's seat shall be deemed vacant whenever the member, without being excused by a majority of the authorized members of Library Board, fails to attend and participate at meetings of the Library Board for a period of at least six consecutive weeks, or for at least three consecutive regular meetings, whichever shall be of longer duration, at the conclusion of such period, provided that the Library Board shall notify the Town as appointing authority in writing of such determination; provided, further, that the Library Board may refuse to excuse only with respect to those failures to attend and participate which are not due to legitimate illness.
