There are hereby established and authorized three retail plenary consumption licenses in the City of Ventnor. The sale, use and renewal of said licenses shall be governed by Chapter 61 of the Code of the City of Ventnor as well as all laws and regulations adopted by the State of New Jersey, including but not limited to those governing intoxicating liquors as set forth in N.J.S.A. 33:1-1.
The issuing authority is hereby established in the City of Ventnor. The issuing authority shall be the Mayor and Commissioners acting together in their official capacity, who are sworn into office, respectively, at the time that any question or issue is brought before the issuing authority.
The definition of any word or phrase used in this chapter shall be the definition as set forth in N.J.S.A. 33:1-1.
No plenary retail consumption license shall be issued for the sale of alcoholic beverages within 200 feet of any church, public school ho use or private school house not conducted for pecuniary profit. The protection set forth in this section of the Code may be waived by the duly authorized governing body of any such church or school; however, such waiver shall only be effective until the date of the next renewal of the license in question. Said 200 feet shall be measured in the normal way that a pedestrian would properly walk from the nearest entrance of said church or school to the nearest entrance of the premises sought to be licensed. This prohibition shall not apply to any licensed premises which existed prior to the construction of any said church or school house if such church or school house were constructed during a time that the licensed premises was already operating. The purpose of this prohibition is to benefit not the property of the church or school house but the persons attending the same.
Each plenary retail consumption license must be renewed to become effective as of July 1 of any given year. Such renewals must be filed pursuant to the laws and regulations as established by the State of New Jersey, Division of Alcoholic Beverage Control and the City of Ventnor. Said renewals must be filed electronically using the POSSE system. Responsibility to timely file any application or renewal shall be on the applicant.
The number to be assigned each license shall be a twelve-digit number as determined by the State of New Jersey, Division of Alcoholic Beverage Control.

The annual fee for the issuance and/or renewal of any plenary retail consumption license shall be in the amount set forth in Chapter 114, Fee Schedule.
The plenary retail consumption licenses to be issued by the City of Ventnor shall only be used in conjunction with an open and operating restaurant located within the City and any applicant with a realistic plan to open and operate a restaurant within the City of Ventnor within 24 months of the acquiring of a plenary retail consumption liquor license, and only in permitted zones as defined in the Municipal Land Use Ordinance of the City of Ventnor. The holder of a retail plenary consumption license within the City of Ventnor shall be entitled to sell any alcoholic beverages for consumption on the licensed premises by the glass or other open receptacle.
No person shall have an interest in more than one plenary retail consumption license within the City of Ventnor. However, nothing herein shall operate to disqualify a guardian, executor, administrator, trustee, receiver or any other fiduciary or Court officer from obtaining or holding more than one license in different official capacities.
No plenary retail consumption licensed establishment may sell alcoholic beverages on any day between the hours of 1:00 a.m. and 11:00 a.m.
