[Added 11-6-2017 by Ord. No. 308-2017]
The purpose of the ODTC Zone is to permit a mix of office and retail uses to provide a more diverse mix of goods and services to residents and businesses within the municipality and region, achieving an improved balance of commercial development within the municipality, and utilizing suitable land for development in an efficient, functional, and aesthetic manner, while minimizing impacts on environmentally sensitive areas. The Town Center Overlay District may only be utilized on tracts of land of a minimum 30 acres.
As used in this chapter, the following terms shall have the meanings indicated:
TRACT
One or more adjacent lots that are under common control at the time of approval of the first land development plan for the property. Various parcels may be in separate legal ownership for the purposes of financing, and smaller lots may subsequently be subdivided and sold consistent with Township ordinances. If any lot is subdivided from the tract, it shall continue to be bound by the ODTC regulations, unless specifically approved otherwise by the Board of Supervisors. If any lot is subdivided from the tract, it shall still be considered to be part of the same land development, and shall not be considered to be a separate land development.
The Town Center Overlay District shall be permitted upon lands within the OR Office/Research Zoning District of the Township subject to the regulations and conditions contained within this article.
The uses permitted within the ODTC Overlay District are those permitted by the underlying zoning district, subject to any modifications herein. Unless otherwise specified herein, any standards established by this article shall supersede any more restrictive standards established elsewhere in this chapter, including those standards for the underlying zoning districts in Articles IV through XVI, other overlay districts in Articles XVIA through XVIE, sign regulations in Article XVII, and the general regulations in Article XVIII. Anything not covered under this article shall be governed by applicable regulation elsewhere in the Zoning and Subdivision and Land Development Ordinances.[1]
