[Adopted 10-1-1979 and 9-14-1981 by Ord. No. 97; amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
As used in this article, the following terms shall have the meanings indicated:
GARBAGE
Putrescible animal and vegetation waste resulting from the handling, preparation, cooking, and consumption of food.
PERSON
Any person, firm, partnership, association, corporation, company, or organization of any kind; or any property owner who willfully or by neglect permits, allows, or causes any garbage, trash or refuse to be deposited on public or private property in violation of this article.
TRASH
Any worn-out or discarded material of any kind, including but not limited to inoperable appliances, scrap metal, furniture, clothing, paper, landscape refuse, rubber, vehicle parts, bottles, plastic, fiberglass, wire, garbage, inoperable motor vehicles, boats, trailers, mobile homes or campers, that are not used or usable for the original intended purpose and which are not in the process of being repaired or stored in a duly licensed junkyard.
It shall be unlawful for any person to maintain or deposit any garbage, trash or debris upon any public or private property, except within a covered receptacle so that said garbage, trash and debris shall not be open to the public view and shall be sufficiently enclosed to prevent the dissemination of offensive odors or infestation by rodents or other vermin.
Any existing or future deposits of garbage, trash or debris within the corporate limits of the Village of Sidney in violation of the requirements of § 200-2 of this article are hereby declared to be a nuisance, and upon receipt of written notice from the Village Marshal or any other authorized representative of the corporate authorities, the person owning or possessing said property on which said garbage, trash and debris is situated shall dispose of said garbage, trash or debris in a lawful manner within five days after receipt of said written notice.
It shall be unlawful for any person to drop, throw, or otherwise deposit any bottles, cans, paper, trash, or debris upon any street or alley or other public property within the Village of Sidney.
It shall be unlawful for any person to burn any garbage, trash or other refuse within the Village of Sidney, except landscape waste may be burned in accordance with Chapter 167, Open Burning, of the Village Code.
The Village President, or someone at his direction, shall provide for the removal of garbage, trash or debris from private property when the owner of such property, after reasonable notice, refuses or neglects to remove such garbage, trash and debris, and the Village President, or someone at his direction, shall submit a statement to the owner of such property for the reasonable cost of said removal. Unless sooner paid, the Village President, or someone at his direction, shall, within 60 days after such expense is incurred, file a notice of lien in the office of the Recorder of Deeds in Champaign County, Illinois, as provided by 65 ILCS 5/11-20-13. Upon payment of the cost by the owner or on his behalf, the lien shall be released. In the event said cost is not paid, then suit for foreclosure of said lien shall be filed within two years after the date of filing said notice of lien.
A. 
Any person violating any of the provisions of this article shall be fined not less than $25 and not exceeding $750. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
B. 
Injunction. In addition to the penalties provided for in Subsection A hereof, any continued, unabated violation of this article, which constitutes a nuisance under § 200-3 hereof, may be enjoined upon the complaint of the Village in any court of competent jurisdiction, with court costs imposable upon the violator, if so ordered by the court.
