A. 
No aboveground gasoline storage tanks shall be permitted in the Village of Sidney, Illinois, on any property which is used or zoned for residential purposes.
B. 
No aboveground gasoline storage tank shall be permitted on any other property in the Village of Sidney, Illinois, if its proposed location or circumstances create an unacceptable risk of harm to persons or property within the Village, as determined by the Board of Trustees or its designated representative.
C. 
Aboveground gasoline storage tanks within the Village limits permitted by this chapter must comply with all applicable federal, state, county and Village laws, ordinances and regulations.
Underground gasoline storage tanks shall be permitted only on commercial or industrial sites appropriate for such usage and only in compliance with all applicable federal, state, county and local laws, ordinances and regulations regarding construction and maintenance of underground gasoline storage tanks.

Anyone violating the provision of this chapter shall be fined not less than $50 and not more than $750 for each violation. Further, since the violation of this chapter will, by definition, create a risk to the public health and safety, the Village may also, through appropriate procedures, prohibit the continued violation of this chapter by injunction or other appropriate remedy, including the forced removal of any tanks maintained or installed in violation of this chapter. Each day that a violation of this chapter continues shall be deemed a separate violation.
