No person, firm or corporation shall burn leaves, brush, sticks, dried foliage, or other plants outdoors within the Village of Sidney unless such material was grown upon or generated from trees, plants, bushes and shrubs growing upon the property located within the Village of Sidney, Illinois, where such burning occurs, and such burning complies with the requirements of Illinois law regarding permissible burning.
No person, firm or corporation shall burn any tires or garbage within the Village of Sidney, Illinois. "Garbage" as used in this section means bones, meat, animal skin, feathers, entrails, organs, nonedible animal parts, grease, food and by-products thereof, coffee grounds, table scraps and similar materials.
No person, firm or corporation shall burn any material outdoors within the Village of Sidney, other than leaves, brush, sticks, dried foliage, or plants generated from trees, plants, and bushes growing upon the property where such burning occurs, as allowed by § 167-1 of this chapter.
No person, firm or corporation shall burn leaves, brush, sticks, dried foliage, or plants permitted by § 167-1 of this chapter under circumstances which create an unreasonable risk of fire or other hazard to himself or other Village residents or their properties, including burning under weather conditions which involve an unreasonable risk of spreading said fire, burning at locations on one's property which are too close to buildings, vehicles, combustible materials or other items involving a risk of damage to persons or property, and burning during the hours of darkness.
This chapter shall not preclude recreational fires, which shall be defined as:
A. 
Fires for the express purpose of cooking food for human consumption. Such fires shall be contained in grills, charcoal burners, or the like; and
B. 
Fires within a dry stacked stone, masonry, or metal fire pit or ring or within a commercially manufactured portable fireplace, but only if:
(1) 
The location of the stone, masonry, or metal fire pit or ring or commercially manufactured portable fireplace shall be at a safe and reasonable distance from any building, structure, or vehicle and from any container or other source of flammable liquids or vapors. No metal fire ring or commercially manufactured portable fireplace shall be placed on any combustible surface; and
(2) 
The fuel shall be dry, seasoned wood or equal, and no household or landscape wastes or leaves shall be burned; and
(3) 
No burning shall take place on private property without the presence and oversight of an adult over 18 years of age. No fires shall be left unattended until entirely extinguished.
All actions in violation of this chapter are hereby determined and defined to constitute a public nuisance and it is in the public interest that such nuisances be prohibited and, if they occur in violation of this chapter, that they be abated by the Village through appropriate judicial order.
A. 
Any person, firm or corporation who or which violates the terms of this chapter shall be punished by a fine of not less than $75 and not more than $750.
B. 
Any individual charged with a violation of this chapter may voluntarily pay such fine as is administratively assessed by the Village, and in that event, no judicial proceedings need be conducted.
C. 
The Village may also enjoin violations of this chapter, in addition to imposing a fine as set forth herein.
