As used in this chapter, the following terms shall have the meanings indicated:
DOWNTOWN AREA
That area of the Village of Sidney which encompasses David Street from the intersection of Byron Street and David Street on the north to the intersection of David Street with Norfolk and Western Railway's tracks on the south, and includes the public right-of-way of said streets at the identified intersections and all intersections along David Street in between the identified intersections and the sidewalk adjacent to David Street in this area which serves pedestrian traffic on each side of the street, including all sidewalks within the right-of-way of said streets and all other sidewalks along David Street in the downtown area which services businesses, homes, or other facilities in the identified downtown area which front on David Street.
IN-LINE ROLLER BLADES
Shoes, boots or other devices which fit on the user's feet which have one row of wheels positioned one behind the other in a line on the bottom which enable the user to move by skating or rolling on said devices.
ROLLER SKATES
This term is identical to the definition of "in-line roller blades" except it shall include foot skating devices which have their wheels configured in some manner other than one-row "in-line" roller blades.
SKATEBOARD
A device upon which the user stands and under which are affixed wheels or rollers which enable the user to transport himself over the surface of the road, sidewalk or other surface by standing on said board surface and rolling on the board's wheels.

It shall be illegal for anyone to transport themselves upon in-line roller blades, roller skates or skateboards on the public streets or sidewalks in the downtown area of Sidney, Illinois, as defined in § 188-1 of this chapter.

A violator of this chapter shall be fined a sum not to exceed $75 for the first offense, and a sum not to exceed $750 for any subsequent offenses.
The Village Attorney is authorized to prosecute any violations of this chapter through the appropriate court of competent jurisdiction in the name of the Village, and may, in addition to the fines imposed by this chapter, if deemed appropriate, seek injunctive relief or other remedies against any violator of this chapter.
A. 
Any violator cited or notified of a violation of this chapter by the Village authorities or the Champaign County Sheriff's Office may tender the designated fine to the Sidney Village Clerk, and, if the Sidney Village Board determines to accept the fine so tendered, then such an administrative fine shall resolve the violation and no judicial prosecution shall follow.
B. 
In determining whether to accept the tender of an administrative fine, the municipal authorities shall consider all relevant circumstances, including the nature and extent of the offense, the time of the offense, the circumstances of the offense, the presence of motor vehicles or pedestrians in the affected area at the time of the offense, any personal injuries incurred, any property damage caused, and any prior offenses of the violator.
