It shall be unlawful for any person or persons, society, association, club, firm or corporation to show, exhibit or conduct anywhere within the limits of the Borough, either on public or private property, any theatrical exhibition, amusement or dance at which an admission or other fee is charged, or other exhibition where the public is admitted or has the right to participate in without first having obtained a permit thereof from the President of the Borough Council. Applications for said permit must be made at least 15 days prior to the date of the event.

The President of the Borough Council shall have and is hereby given discretionary power to refuse a permit under this Part when he deems it to be injurious to public health safety or morals.

The license fee for such a permit shall be fixed as hereinafter stated and shall be collected by the President of the Borough Council and paid into the Borough Treasury and shall be used to defray the expense of police protection at such theatrical exhibition, amusement, dance or other exhibition.

The President of the Borough Council shall have and is hereby given discretionary power to assign a sufficient number of policemen to provide such police protection as the public safety and welfare requires at such theatrical exhibition, amusement, dance or other exhibition.

The license fee for such permit shall be paid and is hereby fixed as follows:
A. 
For each policeman assigned by the President of the Borough Council to provide protection upon the granting of a permit, there shall be paid a license fee in an amount as established, from time to time, by resolution of the Borough Council. This license fee shall cover a period of time from one to five hours.

For each additional hour of service required, there shall be paid for each policeman assigned, an additional license fee in an amount as established, from time to time, by resolution of the Borough Council per hour.

No license shall be issued by the President of the Council under the provisions of this Part until it shall be ascertained that the place for which it is issued complies with and conforms to all laws, ordinances, health and fire regulations applicable thereto, and is a safe and proper place for the purpose for which it is to be used.

Any police officer shall have power to cause any place where any theatrical exhibition, amusement, dance or other exhibition is carried on, to be vacated whenever any provision of any law or ordinance with regard to public health or safety is being violated, or whenever any indecent act shall be committed or when any disorder of a gross, violent or vulgar character shall take place thereon.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs together with reasonable attorney fees and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.
