As used in this chapter, the following terms shall have the meanings indicated:
CONTRACT
The current agreement entered into by and between the Village and Brown County.
COUNTY
Brown County.
DENMARK POLICE DEPARTMENT
Any officer of the Village of Denmark as designated by the contract.
A. 
In accordance with § 61.65(2), Wis. Stats., the Village hereby elects to contract for police protection services with Brown County. The Village Board reserves the right to amend this section of this chapter at such time that it deems appropriate for the good of the Village.
B. 
From time to time the Village shall negotiate a contract with Brown County that addresses staffing levels, finances, appointment of the Denmark Police Department, and disciplinary actions.
C. 
The Denmark Police Department shall possess the powers, enjoy the privileges, and be subject to the liabilities conferred and imposed by law upon marshals and constables. The Police Department shall:
(1) 
Obey the lawful written orders of the Village Board.
(2) 
Cause the public peace to be preserved and see that all laws and ordinances of the Village and state are enforced, and whenever any violation thereof comes to its knowledge, it shall cause the requisite complaint to be made and see that the evidence is procured for the successful prosecution of the offender.
(3) 
Subject to the contract between Brown County and the Village, exercise supervisory control over all personnel of the Department and may adopt, subject to the approval of the Village Board, rules and regulations for the government, discipline, equipment, and uniforms of police officers.
(4) 
Be solely responsible for the care and condition of the equipment used by the Department.
(5) 
Keep an accurate and complete record of all complaints, arrests, traffic violations, convictions, and dispositions of the Department.
(6) 
Make budget recommendations for the coming year to the Treasurer by September 1 of each year.
A. 
General powers and duties. Each officer of the Department shall possess the powers conferred on marshals and constables by law, shall preserve the public peace and shall enforce the laws and ordinances of the state and Village subject to the orders, rules, and regulations of the Denmark Police Department and the Village Board.
B. 
Power of arrest. The Denmark Police Department and any police officer shall arrest all persons in the Village found in the act of violating any law or ordinance of the Village or state or aiding or abetting in such violation; shall arrest without warrant any person who they have reasonable grounds to believe has violated any law or ordinance and who would not be apprehended unless immediately arrested; shall take any arrested person in charge and confine him in the county jail; and shall, within a reasonable time according to state law, bring such person before the court having jurisdiction thereof to be dealt with according to law.
Rules and regulations governing the Police Department shall be adopted from time to time by the Denmark Village Board.
