[HISTORY: Adopted by the Borough Council of the Borough of

The Borough Council of the Borough of Bath hereby signifies
its intention and desire to organize an Authority under the provisions
of the Municipality Authorities Act of 1945, as amended.[1],[2]

Editor's Note: Section 3 of Ord. No. 158 directed the
appropriate officers to cause the advertisement of the ordinance;
Section 4 directed the President and Secretary of Council to file
the Articles of Incorporation with the Secretary of the Commonwealth;
Section 6 named the first members of the Authority board, and stated
their terms of office, to be computed from January 1, 1954; Section
7 repealed all inconsistent ordinances, resolutions and parts thereof;
Section 8 provided that the ordinance become effective upon final
passage.
The Mayor and the President and Secretary of Borough Council
are hereby authorized and directed to execute on behalf of the Borough
Council of the Borough of Bath, Articles of Incorporation for said
Authority, in substantially the following form:

In compliance with the requirements of the Act of May 2, 1945,
P.L. 382, known as "Municipality Authorities Act of 1945," as amended,
the Borough Council of the Borough of Bath, Northampton County, Pennsylvania,
desiring to incorporate an Authority thereunder, does hereby certify:

The name of the Authority is "Bath Borough Authority."

2.

Said Authority is formed under the provisions of the Act of
May 2, 1945, P.L. 382, as amended.

3.
|
No other Authority organized under the Act of May 2, 1945, P.L.
382, as amended, or under the Act of June 28, 1935, P.L. 463, as amended,
is in existence in or for the incorporating municipality, the Borough
of Bath.

4.
|
The name of the incorporating municipality is the Borough of
Bath, Northampton County, Pennsylvania.

The names and addresses of its municipal authorities are as
follows:[2]

The names, addresses and terms of office of the first members
of the Board of the Municipal Authority to be formed hereby are as
follows:[3]

The ordinance authorizing the creation of said Authority, certified
from the records of the Borough Council of the Borough of Bath, together
with advertisement of notice of filing these Articles of Incorporation,
are each submitted herewith.

The term of existence of said Bath Borough Authority shall be
for a period ending on December 31, 2028.

The project which will be undertaken by the said Authority is:
to acquire, hold, construct, improve, maintain, operate, own, lease
either in the capacity of lessor or lessee, waterworks, water supply
works and water distribution systems; and to acquire, hold, construct,
improve, maintain, operate, own, lease either in the capacity of lesser
or lessee, sewers, sewer systems or parts thereof sewage treatment
works, including works for treating and disposing of industrial waste
for the Borough of Bath and for such other territory as it may be
authorized to serve.
