This chapter shall be known as "Recognition of Emergency Medical
Services Company."
Bethlehem Township Volunteer Fire Company is a Pennsylvania
nonprofit corporation organized and existing under the laws of Pennsylvania.
Bethlehem Township Volunteer Fire Company is also organized and existing
in the Borough of Bath, Northampton County, Pennsylvania. The Borough
of Bath, Northampton County, Pennsylvania (the "Borough") hereby designates
Bethlehem Township Volunteer Fire Company as the officially recognized
emergency medical services company ("EMS Company") for the Borough.
A.
EMS Company recognized by the Borough is hereby authorized to provide
such services within the Borough as may be necessary for the protection
of persons situate therein, which shall include, by way of example
and not of limitation, the prevention of loss of life from fire, automobile
accidents, medical emergencies, hazardous materials incidents, and
other dangerous situations.
B.
EMS Company may also engage in the performance of any lawful activity.
C.
EMS Company shall provide to the Borough an annual itemized listing
of all expenditures of funds received from the Borough before the
Borough may consider budgeting additional funding for EMS Company.
Neither the recognition set forth in § 49-2 nor the grant of authorized activities in § 49-3 shall be construed as constituting EMS Company as an agent, department or employee of the Borough except insofar as such effect is provided under the provisions of the Act of October 5, 1980, P.L. 693, No. 142, known as the "Political Subdivision Tort Claims Act."[1]
