The Borough of Bath Non-Uniformed Pension Plan and Trust is amended and restated in its entirety by adoption of a preapproved governmental defined contribution plan and related trust sponsored as a volume submitter document by HUB International Limited as offered through the Pennsylvania Municipalities Pension Trust as set forth in such preapproved governmental defined contribution plan adoption agreement and accompanying Internal Revenue Service opinion letter all to read as set forth in Exhibits A-1 through A-3, which documents are incorporated herein by reference and are on file in the office of the Borough Secretary.

The Borough of Bath 457 Deferred Compensation Plan and Trust is amended and restated in its entirety pursuant to a supplemental participation agreement with the Pennsylvania Municipalities Pension Trust to become a participating employer in a governmental eligible, tax exempt deferred compensation plan and related trust under Section 457 of the Internal Revenue Code of 1986,[1] as amended to read as set forth in Exhibit B, which executed document is incorporated herein by reference and is on file in the office of the Borough Secretary.
