GENERAL REFERENCES
Fire prevention — See Ch. 310.
No person or persons, firm, associations, partnerships, or corporation
shall make or cause to be made, sell, offer for sale, expose to sale,
use, fire, explode, discharge, or throw any squib, racket, firecracker,
lady cracker, or any substance or device designed or intended for
pyrotechnical display or celebration or used for that purpose.
The Mayor of the Borough may issue, and is hereby authorized
and directed to issue permits for the public display of certain fireworks
by properly qualified individuals working under the auspices of committees,
associations, and organizations, and under the direct supervision
of persons experienced in handling fireworks at times and in places
to be specified in the said permit, and under proper provision for
the protection and safety of human life and property; and such permit
shall specify the name of the association, committee, or organization
applying for and receiving the same; the names of the persons who
shall be in the direct control of the display; the nature and kind
of display permitted to be given; and the time and the place of the
said display; and for the issuance of such permit the Mayor shall
collect and receive the fee of not exceeding $25 to be paid into the
Treasury of the Borough.
A.
Any person who shall violate any of the rules and regulations contained
in this chapter shall, upon conviction thereof, be sentenced to pay
a fine of not more than $600 and costs of prosecution for each and
every offense.
B.
Each day's violation of any of the provisions of such section
shall constitute a separate offense.

In addition,
court costs and reasonable attorney fees incurred by the Borough in
enforcement proceedings shall be assessed against violator and awarded
to the Borough.
