[Adopted at time of adoption of Code (see Ch. 1, General Provisions, Art. II)]
The purpose of this chapter is to set forth the City's Buildings and Building Regulations and it is intended to be read and applied in conjunction with the provisions of all articles within this chapter of the City Code, under which the City of Lapeer assumes responsibility for the administration and enforcement of the Stille-Derossett-Hale Single State Construction Code, Act 230 of 1972, MCLA § 125.1501 et seq. (the "Act"), as amended from time to time, throughout its corporate limits and which designates the City's Building Official or designee as the enforcing agency to discharge the responsibility of the City of Lapeer under the Act.
A. 
For the purposes of this chapter, there shall be a Building Official or designee as designated by the City Manager. This Building Official or designee shall be responsible for the issuance of all permits and the inspection of all work done under the provisions of the mechanical, electrical, plumbing and building codes of the City and the safety inspection of all premises, including structures thereon, as provided herein.

For the purposes of this chapter, whenever the phrase "Building Official," "Building Inspector" or "code official" is used in this chapter, it shall be synonymous with the Building Official or designee.
Fees for applications, plan reviews, permits, inspections, licenses, registrations, appeals and other charges or penalties shall be as specified in the City of Lapeer Fee Schedule (the "Fee Schedule") approved by the City Commission, as amended from time to time.
Bonds shall be posted before the issuance of a building permit for new construction, or for other construction as determined in the discretion of the Building Official as provided in the Fee Schedule. The bonds shall assure that the public right-of-way is consistently maintained at all times during construction, provide a fund for payment for damages to public property and/or utilities caused by construction, guaranty completion of work sufficient to obtain a final certificate of occupancy, and provide a fund for payment of outstanding and unpaid water, sewer street cleaning, barrier erection, and any other such charges determined by the City to be unpaid. Bonds shall be returned without the payment of interest when a final certificate of occupancy has been issued, less any amounts required to be used by the City in accordance with this chapter.
In accordance with the provisions of the Act, the City of Lapeer Construction Board of Appeals is hereby established and shall perform its duties in accordance with said Act and all applicable codes and/or statutes as required within said Act. The Board shall propose by-laws and rules of procedure for approval by the City Commission.
All ordinances inconsistent with the provisions of this chapter are hereby repealed.
Except as otherwise provided in other sections or articles of this chapter, a violation of any section, article or provision shall be considered a civil infraction and subject to the provisions of Chapter 62, Civil Infractions, of the Code of the City of Lapeer.
