From and after the date of enactment hereof, disposal of leaf waste shall be mandatory and in accordance with this article. All persons in the Borough shall separate all leaf waste from all other MSW, recyclables and riffraff produced at their dwellings, establishments or unimproved land and shall store such leaf waste for collection. All owners or occupiers of dwelling units, mixed use, commercial, industrial or institutional establishments and owners of unimproved land shall dispose of such leaf waste at the facility designated by resolution of the Bath Borough Council from time to time, or place such leaf waste streetside on collection dates designated by the Borough in containers which are acceptable to the Borough's leaf collection contractor. Prior to January 31 of each year or within 10 days after acquiring or occupying a dwelling unit, mixed use, commercial, industrial or institutional establishment or acquiring unimproved land located within the Borough, as the case may be, the occupant or owner thereof shall apply for and obtain a leaf waste disposal permit issued by the Borough by applying for said permit at the Borough Office and paying the fee required by § 535-27 herein. Nothing herein shall preclude on-site leaf waste containment and composting, so long as it does not create odors or attract or harbor vermin.
Designated leaf waste shall consist of those items listed in the definition hereof. The designated list may be amended from time to time by resolution of the Bath Borough Council.
All designated leaf waste shall, from the time of disposal at the facility designated by the Borough by Resolution, become the property of said facility or, from time of pickup by the Borough, become the property of the Borough.
It is the intent of this article that the reasonable accumulation of leaf waste of each person covered by this article may be disposed of at the facility designated by resolution of the Bath Borough Council for the standard charge established from time to time by resolution by Bath Borough Council. The facility designated by resolution of the Bath Borough Council and the Borough may refuse to collect unreasonable amounts of leaf waste or may make any additional charge for excessive amounts disposed of at the facility designated by resolution of the Bath Borough Council or placed for collection streetside on collection dates designated by the Borough.
A. 
All leaf waste originating within the Borough of Bath shall be disposed of only as herein provided. No person or its agents shall collect, remove, haul or convey leaf waste through or upon any of the streets of the Borough or dispose of the same in any manner or place, except as herein provided.
B. 
Preparation of leaf waste.
(1) 
All leaf waste shall be drained of liquid before placement in any refuse container.
(2) 
Any and all sewage and industrial wastes, poisons, acids, caustics, explosives, hazardous wastes, infectious materials, and any other dangerous materials and substances shall be removed from the leaf waste before placement in any leaf waste container, and the possessor thereof shall arrange for its prompt and safe disposal at his/her/its own expense.
C. 
Leaf waste containers.
(1) 
All leaf waste to be removed from any property in the Borough shall be placed in containers.
(2) 
Leaf waste containers shall be of durable, watertight, rust-resistant material adequate to contain the leaf waste placed in them.
(3) 
Containers containing leaf waste to be collected by the Borough shall be limited to a thirty-gallon capacity and when filled shall weigh no more than 40 pounds.
(4) 
Plastic bags may be used as leaf waste receptacles, providing they are sealed to prevent the scattering about of their contents and do not contain any rips, tears or punctures.
(5) 
All containers shall be kept in a sanitary condition and shall be kept in good repair.
(6) 
All containers shall be adequate to fully contain the volume of leaf waste to be disposed of. Overflowing containers are strictly prohibited.
D. 
Streetside placement of leaf waste containers.
(1) 
Leaf waste in leaf waste containers provided for herein may be placed at curbside for collection on collection dates designated by the Borough.
(2) 
Leaf waste in leaf waste containers provided for herein may be placed at curbside for collection not earlier than 3:00 p.m. on the day preceding a scheduled pickup.

(3) 
Leaf waste containers shall be removed from curbside within 12 hours of a scheduled pickup.
E. 
Disposal of leaf waste at leaf waste facility. All owners or occupiers of dwelling units, mixed use, commercial, industrial or institutional establishments and owners of unimproved land, shall dispose of such leaf waste at the facility designated by resolution of the Bath Borough Council from time to time in accordance with the rules and regulations of said facility and in accordance with this article.
The Bath Borough Council shall, from time to time, by resolution, establish, a schedule of fees for the collection and disposal of leaf waste, and amend said schedule from time to time, by resolution, as the need for amendment may arise. The proceeds of said fee may be applied toward the general fund. The Bath Borough Council may also establish a schedule of fees for special collections and disposal of leaf waste.
