A. 
Refuse and recycling fees; leaf waste fees. Any person who shall fail or refuse to pay in full refuse, recycling or leaf waste fees, together with interest and penalties established pursuant to this chapter or pursuant to schedules or regulations promulgated hereunder, within three months of the date the invoice therefor was mailed to such person, shall, upon conviction thereof, be fined no less than $100 nor more than $500 and costs of prosecution (including legal fees). Nothing set forth in this Subsection A shall absolve any person from such person's obligation to pay refuse, recycling or leaf waste fees when due, whether or not other penalties are also imposed.
B. 
Other violations.
(1) 
Any person who shall violate any provision of this chapter other than those set forth Subsection A above shall receive a written warning for the first offense. Thereafter, all such violations shall be subject to the penalties hereinafter provided.
(2) 
Any person who shall violate any provision of this chapter other than those set forth Subsection A above shall, following remittance of a written warning and conviction thereof, be fined not less than $100 nor more than $500 and costs of prosecution (including legal fees).
C. 
Any person who shall fail or refuse to timely pay fines and costs, as levied by a Magisterial District Judge, within such time period as is established by the Magisterial District Judge, shall undergo imprisonment for not more than 30 days. Each day that any violation of any provision of this chapter continues shall constitute a separate violation.
D. 
In addition, court costs and reasonable attorney fees incurred by the Borough in enforcement proceedings shall be assessed against violator and awarded to the Borough.

In addition to the foregoing penalty, the Borough may require the owner or occupant of a property to remove any accumulation of MSW, recyclables or uncontained leaf waste, and should said person fail to remove such MSW, recyclables or uncontained leaf waste after 10 days following written notice, the Borough may cause the MSW, recyclables or leaf waste to be collected and disposed of, with the costs of such actions to be charged to the owner or occupant of the property in a manner provided by law.
