No person may place, erect, maintain, or permit the placement, erection or existence of a dangerous mailbox, or similar device, support(s), and/or protection(s) thereto, or other objection within or upon any public terrace, street, or other public right-of-way within the Village. For the purpose of this section, such mailbox or similar device support(s) thereto and other objections shall constitute a public nuisance.
For the purpose of this chapter, the following terms shall have the meaning indicated:
DANGEROUS
Supported and/or protected by concrete, concrete pillars, brick, steel, iron, or such other material(s) and/or dimension(s) as create, tend to create, pose or present a real or potential hazard to vehicular, bicycle, or pedestrian traffic.
Each mailbox or similar device, support(s), and protection(s) thereto shall be constructed, repaired, replaced, and at all times maintained in conformity with not less than the minimum standards promulgated and/or recommended by the Wisconsin Department of Transportation, as from time to time amended, which standards are incorporated herein by reference as if fully set forth, including, but not limited to:
A. 
Support(s) shall be of such design and material as to "break away" and not remain fixed or rigid in the event of an accident.
B. 
Support(s) may be wood posts four inches by four inches square or 4.5 inches in diameter.
C. 
Support(s) may be of soft metal not greater than 2.5 inches in diameter.
D. 
Support(s) shall not be imbedded greater than 24 inches into the ground.
Each mailbox or similar device, support(s), and/or protection(s) thereto constructed, repaired, replaced, or maintained contrary to any provision and/or requirement set forth in this section shall be removed by the abutting property owner and/or possessor within 10 days of notification from the Village Engineer ordering such removal. In the event that such owner and/or possessor fails to remove such nonconforming and/or violative mailbox or similar device, support(s), and/or protection(s) thereto, the Village Engineer may, without additional notice, remove or cause the removal thereof. The cost(s) for such removal may be filed as a special assessment statement/charge against such abutting real property with the Village Clerk, entered upon the tax rolls therefor, and collected as other special assessments and taxes upon real property.
