[HISTORY: Adopted by the Village Board of the Village of Winneconne as Title 5, Ch. 5, of the 2012 compilation of ordinances, as amended through 5-22-2013. Subsequent amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
EMERGENCY MANAGEMENT
The preparation for and the carrying out of all emergency functions other than functions for which the military forces are primarily responsible, to minimize and repair injury and damage resulting from disaster caused by an enemy attack, sabotage or other hostile action or by fire, flood or other natural causes.
A.ย 
Appointment. The Emergency Management Director (sometimes referred to as the "Head of Emergency Management Services") shall be a qualified person annually appointed at the organizational meeting by the Village President, subject to confirmation by the Village Board.
B.ย 
Duties and powers. The Director shall be the executive head of the Village Emergency Management organization and shall have direct responsibility for the organization, administration and operation of the organization, subject to the direction and control of the Village President and the Village Board. In addition to such powers and responsibilities as may be imposed on him/her from time to time by the Village Board, he/she shall have the authority and it shall be his/her duty to:

Coordinate all activities for Emergency Management within the Village.
(2)ย 
Maintain liaison and cooperation with Emergency Management agencies and organizations of other political subdivisions and of the State and Federal Management.
(3)ย 
Participate in County and State Emergency Management activities upon request.
(4)ย 
Prepare a comprehensive general plan for the Emergency Management of the Village and present such plan to the Village Board for approval.
(5)ย 
Subject to the approval of the Village Board, enter into a mutual agreement with other political subdivisions and file copies of any such agreements with the State Director of Emergency Management.
(6)ย 
Upon the declaration of an emergency, issue all necessary proclamations as to the existence of such state of emergency and such disaster warnings or alerts as shall be required in the Emergency Management plan.
(7)ย 
Ensure the National Incident Management System (NIMS) is implemented to provide a systematic, proactive approach to guide all departments and agencies of the Village, nongovernmental organizations, and the private sector to work seamlessly to prevent, protect against, respond to, recover from, and mitigate the effects of incidents, regardless of cause, size, location, or complexity, in order to reduce the loss of life and property and harm to the environment.
In preparing and executing the Emergency Management Plan, the Director shall utilize the services, equipment, supplies and facilities of the existing departments and agencies of the Village to the maximum extent practicable. When the Village Board has approved of the plan, it shall be the duty of all municipal agencies and departments of the Village to perform the duties and functions assigned by the approved plan.
The Emergency Management organization shall take action in accordance with the Emergency Management plan only after the declaration of an emergency and issuance of the official disaster warning. Declaration of emergency shall be made by the Governor, the Village President or, in his/her absence, by the Director. Such state of emergency shall continue until terminated by the issuing authority, provided that any declaration not issued by the Governor may be terminated by the Village Board.
Whenever necessary to meet an Emergency Management emergency for which adequate regulations have been adopted by the Village Board, the Village President and, in his/her absence, the Director of Emergency Management, may proclaim, promulgate and enforce orders, rules and regulations relating to the conduct of persons and the use of property which are necessary to protect the public peace, health and safety, and preserve lives and property, and to ensure the cooperation in Emergency Management activities. Such proclamation shall be posted in three public places and may be rescinded by resolution of the Village Board.

No person shall willfully obstruct, hinder or delay any member of the Emergency Management organization in the enforcement of any order, rule, regulation or plan issued pursuant to this section or violate any order, rule, regulation or plan issued pursuant to the authority contained in this section. Any person who shall violate any provision of this chapter shall, upon conviction thereof, be subject to a penalty as provided in ยงย 323.28, Wis. Stats.
The Emergency Management Operations Ordinance for Winnebago County adopted by the Winnebago County Board and updated from time to time, is adopted and hereby made a part hereof, by reference, and is hereby ratified and accepted by the Village Board of Winneconne.
A.ย 
This ratification and acceptance of the Emergency Management Operations Ordinance shall constitute a Mutual Agreement between the Village and County of Winnebago as provided by ยงย 6.08(3) of the County Emergency Management Operations Ordinance.
